Waterville man charged with arson in city cemetery fires

WATERVILLE — A city man has been charged with arson in connection with two cemetery fires set July 21 in the city’s South End, according to police.

Jon Duffy, 34, of Waterville, was summoned Friday by Officer Steve Brame on two charges of arson after Duffy confessed to the crime, police said.

People who live in the area and others who saw the fires were interviewed by Brame during the investigation, according to police. The first fire was reported around 1 p.m. at Pine Grove Cemetery and the second was reported around 2 p.m. at adjacent St. Francis Cemetery. Both were fires in piles of brush that were put out quickly by Parks and Recreation Department workers on the scene before firefighters arrived.

St. Francis Cemetery reported little damage. The fire was in an undeveloped space, so there was nothing to fix, Director Mike Hebert said.

Pine Grove Cemetery did not return a phone call immediately.

Duffy reportedly was seen in the area of both fires and was seen leaving the scene of the second fire, Deputy Chief Bill Bonney said.

Duffy confessed to committing both arsons but did not offer a clear motive, Bonney said. Duffy, who has no criminal record, also reportedly was seen watching a fire in the city before, Bonney said.

“This is somebody who’s been infatuated with fire,” Bonney said.

Arson is a class A felony, punishable by up to 30 years in prison and a fine of up to $50,000. “It is a serious charge,” Bonney said.

Duffy is scheduled to appear Sept. 26 in Kennebec County Superior Court.

Former St. Dominic’s Academy soccer coach pleads guilty to cocaine trafficking

AUGUSTA — A Monmouth man who coached the junior varsity boys’ soccer team at St. Dominic’s Academy last year began serving 20 months behind bars Monday for trafficking in cocaine.

That was the unsuspended portion of the eight-year sentence imposed on John Brissette, 37, after he pleaded guilty in the Capital Judicial Center to unlawful trafficking in cocaine that occurred Dec. 8. 2015, in Monmouth. He also forfeited $1,534, which the prosecutor said was found bundled next to the cocaine.

The prosecutor, Assistant Attorney General Katie Sibley, told Supreme Court Associate Justice Donald Alexander that investigators with the Maine Drug Enforcement Agency “set up a buy-bust situation,” giving a Bowdoin resident marked money with which to buy cocaine from Brissette.

She said the buyer drove to Brissette’s home and purchased 14 grams of cocaine from him.

Shortly afterward, agents searched Brissette’s home, she said, finding three bags containing a total of 110 grams of cocaine and close to $2,000 cash bundled next to it in the kitchen. Brissette was arrested then.

Sibley said that once the buyer’s money was subtracted, the amount totaled $1,534.

Conditions of the three-year probation, which follows the unsuspended portion of the jail time, prohibit Brissette from possession and use of alcohol and illegal drugs and require him to undergo substance abuse evaluation and counseling if required. Sibley also told the judge that she was aware that Brissette already had started counseling.

He also was fined $400 and ordered to pay $120 restitution for the drug testing.

In exchange for the pleas, a charge of aggravated trafficking in cocaine and two counts of unlawful trafficking in marijuana, all dated Dec. 8, 2015, were dismissed. Sibley had said previously that 1.1 pounds of marijuana was found at Brissette’s home.

Brissette’s defense attorney, Walter McKee, said Monday that Brissette had no prior criminal record.

Four people watched the brief hearing Monday, but no one other than attorneys and Brissette spoke to the judge.

In an emailed statement at the time Brissette was arrested in December, St. Dominic Academy President Donald Fournier said, “John Brissette has only served as a part-time coach at the academy and his current contract has expired,” Fournier said.

Fournier also said law enforcement officials told the academy that there was “no information that the charge is related to the academy, its students, or staff.”

Registered sex offender accused of sexual misconduct with Waterville child

WATERVILLE — A registered sex offender was arrested early Sunday morning after alleged sexual misconduct with a child, police said.

Steven Bragdon, 31, of Vassalboro, was arrested at 1:31 a.m. after a parent called police. He was charged with sexual misconduct with a child less than 14 years old, a class D misdemeanor; and prohibited contact with a minor, a class E misdemeanor. He was also being held for violating probation.

Bragdon allegedly was electronically contacting a 12-year-old, who lives in Waterville, and having inappropriate conversations over several weeks. Waterville police Deputy Chief Bill Bonney said the alleged contact could be considered “grooming-type contact.” Bonney said Bragdon was an acquaintance of the child and the parents.

Bragdon also allegedly sent an explicit photo to the child over social media, Bonney said.

Bragdon, who is a registered sex offender, has been convicted for possessing sexually explicit material depicting a child under the age of 12 and was on probation for that charge, with the condition that he was not allowed to contact minors.

New York man, Augusta woman sentenced for drug trafficking

AUGUSTA — A Manhattan, New York, man was sentenced Monday to two years in prison for trafficking in cocaine base and for possession of a firearm by a prohibited person, and an Augusta woman was sentenced to four years in prison for drug trafficking.

William K. Seabron, also known as “Haze,” 25, pleaded guilty Monday to both those charges during a hearing at the Capital Judicial Center. He also was ordered to pay a $400 fine.

The cocaine trafficking occurred Feb. 4, 2016, on Western Avenue, and the illegal firearm possession occurred Jan. 27, 2016, both in Augusta.

In exchange for the pleas, other charges were dismissed: two counts of receiving stolen property, both dated Jan. 27, 2016, and involving firearms; two counts of unlawful trafficking in heroin, Feb. 4, 12 and Feb. 24, 2016; and two counts of unlawful trafficking in cocaine base on Feb. 12 and Feb. 24, 2016, and all in Augusta.

The prosecutor, Assistant Attorney General Katie Sibley, said Seabron told officers he had bought a firearm, which he did not know was stolen, and gave it to police when they arrived at his apartment. The indictment says Seabron has a prior felony conviction from February 2010 in New York and is therefore prohibited from having a firearm.

Sibley also said Seabron sold the cocaine base to a person who was wearing a recording device.

In July 2014, Seabron was riding in a taxi on Western Avenue when officers halted it with guns drawn. He was charged at that time with robbery, marijuana trafficking, misuse of credit identification and unlawful possession of drugs in connection with the theft of purses.

On Jan. 9, 2015, the robbery charge was dismissed and Seabron pleaded guilty to other charges, including misuse of identification and theft by unauthorized taking as well as unlawful trafficking in scheduled drugs and unlawful possession of scheduled drugs, and another count of theft by unauthorized taking. He also agreed to a criminal forfeiture of $835 cash.

He was ordered to serve an initial five months in jail and the remainder of the 364-day sentence was suspended. He was placed on probation for a year and later served an additional six months in jail for violating that probation.

Seabron’s attorney, Andrei Maciag, told the judge his client was arrested March 16, 2016, and that he was hoping to be credited with the amount of time he already had served. Macaig also said that a companion case in southern Maine also was to be dismissed.

Supreme Court Associate Justice Donald Alexander told Seabron the penalties in the federal system for a felon in possession of a firearm are heavier.

“I guess you’re fortunate to be charged by the state in this instance,” Alexander said.

At a separate hearing also held Monday, Toni L. Geisinger, 28, of Windham and formerly of Augusta, was sentenced to four years in prison after she pleaded guilty to unlawful trafficking in crack cocaine, which took place Nov. 24, 2015, in Augusta. She was also fined $400.

Police: Crack cocaine found in Pennsylvania man’s boxer shorts during Augusta traffic stop

AUGUSTA — A Pennsylvania man who reportedly had crack cocaine in his boxer shorts is facing charges of unlawful trafficking in cocaine base and illegal importation of cocaine into Maine.

Isaiah Dunham, 20, of Allentown, Pennsylvania, was arrested Friday after a traffic stop on Fuller Street in Augusta.

On Monday, a judge kept Dunham’s bail at $25,000 following an initial hearing Monday at the Capital Judicial Center via video from the Kennebec County jail.

Assistant District Attorney Tracy DeVoll said Dunham had faced a robbery charge in Pennsylvania, but she was unable to determine its outcome as of Monday. Dunham also is the subject of an arrest warrant in Pennsylvania, but authorities there declined to extradite him, she said.

Records from the Court of Common Pleas in Lehigh County, Pennsylvania, indicate Dunham forfeited $5,000 bail after failing to appear in court there in January 2016 on a charge of giving false identification to a law enforcement officer.

Dunham was arrested Friday in Augusta during the traffic stop after a drug-sniffing dog indicated Dunham had drugs on him. After being confronted by police, Dunham “admitted to having several grams of crack cocaine hidden in his boxer shorts,” according to an affidavit by Detective Michael Bickford, of the Kennebec County Sheriff’s Office. Dunham then gave the drugs to the police.

It also said that officers found bus tickets from Lewiston to Boston, and tickets from Boston to New York, dated July 28, 2016, in the rear seat where Dunham had been sitting. Dunham initially was reported as being from Bronx, New York.

Dunham said the car was being driven by Kimberly Hopkins, 35, of Augusta, who is free on bail conditions requiring her to submit to search and test at any time. Hopkins was indicted in June on charges of unlawful trafficking in heroin, Feb. 11, 2016, unlawful possession of heroin and unlawful possession of cocaine base, and two counts of endangering the welfare of a child, all March 9, 2016, and all in Augusta. She is scheduled for a hearing later this month at the Capital Judicial Center.

Hopkins was permitted to leave the scene, as was Greagoray Baynard, also of Allentown, Pennsylvania, another passenger in Hopkins’ vehicle.

Dunham also appears to be the same person who was the victim of a shooting that took place in February 2014 in Allentown, when he was 17.

Conditions of Dunham’s bail prohibit him from having contact with Hopkins and Baynard.

Cornville man convicted of terrorizing still in jail as place for him to live sought

SKOWHEGAN — A probation hearing for a Cornville man jailed last month after his release from Riverview Psychiatric Center because he has no place to live has been continued to Aug. 17, his lawyer said.

James L. Mayo, 45 was scheduled to appear in court Tuesday. His court-appointed lawyer, Phil Mohlar, of Skowhegan, said on Monday that the hearing had to be moved because state officials have yet to find Mayo a place to live in the community. Mayo remains held without bail at the Somerset County Jail in East Madison, according to a jail intake worker.

Mayo was sent to the Riverview Psychiatric Center in November after he was deemed incompetent to stand trial on terrorizing charges. Mayo later was found competent to face the felony terrorizing charge in June after months of treatment at Riverview. He pleaded guilty to the charge June 29 and was sentenced to serve two years in prison, with all but eight months and 25 days suspended. He was released the same day — June 29 — because he’d already served the eight months and 25 days in both the county jail and at Riverview.

Mayo is no longer a patient at Riverview, Mohlar said. He is serving two years of probation as part of the terrorizing plea. He has been ordered by the court to maintain his medication plan as part of his probation.

Mayo was arrested July 6 after he allegedly failed to show up at Riverview for a scheduled doctor’s appointment after his release from the hospital and for allegedly failing to meet with a probation officer within 48 hours of his release.

He was out on probation when the doctor’s appointment was missed, but when state corrections officials saw the conditions he was living in, they asked that his probation be revoked until satisfactory living conditions could be established.

In documents filed in court in Skowhegan, it was noted that after Mayo’s release from Riverview, he was living with his mother in Cornville in a small room with no bed. He was sleeping on the floor, according to the court files. The recommendation is that Mayo be held without bail until “adequate housing, medical, mental health and pharmaceutical services can be established.”

“Without a proper plan in place, this client has shown on multiple occasions that he will fail and public safety would be at risk,” court documents read.

Mayo was arrested in early October for threatening to kill a family of three in Skowhegan and to shoot police if they were called. He was arrested a second time that weekend for breaking bail conditions by drinking alcohol, police said. It is that terrorizing charge that he pleaded guilty to June 29, according to court records.

Even with a proper plan in place, state corrections officials still want to keep an eye on Mayo, who has been convicted three times in recent years of terrorizing and threatening people. Mayo was convicted twice before on threatening and terrorizing charges. He was convicted of criminal threatening with a dangerous weapon in December 2012 and terrorizing in March 2014.

Pittston woman arrested for alleged robbery of Big Apple in Augusta

AUGUSTA — City police arrested a Pittston woman Tuesday in connection with the June 21 robbery of The Big Apple convenience store on Stone Street.

Police also charged an Augusta man with helping the woman, after he was arrested last week in connection with a separate robbery of the store.

Jessica Morang, 37, of Pittston, was arrested on a charge of robbery, Deputy Chief Jared Mills said in a news release.

Morang was arrested after an store employee reported that a white woman had demanded money and left on foot with an undisclosed amount of it, Mills said.

A security camera at the store captured photos that police released that morning. In the photos, a suspect wearing a hooded sweatshirt, plaid pajama pants and sunglasses could be seen entering the store and speaking to the employee.

On Tuesday, police also charged Abraham C. Matt, a 30-year-old Augusta man, with being Morang’s accomplice in the June robbery.

Last week, Matt also was arrested and charged with robbing the same convenience store on the night of July 24. He left on foot with $90 in cash, Detective Jesse Brann wrote in an affidavit. Brann also said Matt “admitted he was a heavy narcotics user and that he had robbed the store to pay a drug debt.”

At Matt’s initial court appearance Friday, a judge set his bail at $5,000. Morang’s bail was set at $2,500, Mills said Tuesday.

Police suspect that Matt drove Morang, his girlfriend, to and from The Big Apple on June 21, Brann wrote in the affidavit.

Skowhegan woman facing felony child sexual assault charges

SKOWHEGAN — A 29-year-old Skowhegan woman is scheduled to appear in court Wednesday on two felony charges involving an alleged sexual assault on a 14-year-old boy.

Jessica Lynn Wells was arrested Monday on charges of gross sexual assault, a class B felony; and sexual abuse of a minor, a class C felony, according to court records. She remained confined Tuesday at the Somerset County Jail in East Madison pending her initial appearance in court, when she will be assigned a court-appointed attorney for the day.

The charges allege sexual assault and sexual abuse of a boy for whose long-term care Wells was partly responsible. The crimes are alleged to have taken place July 13 in Skowhegan, according to court records.

Police were first alerted to the alleged assault on July 29 and investigated. The boy’s mother reportedly received a text message from him and alerted authorities.

A caseworker with the state Department of Health and Human Services conducted interviews in Skowhegan, according to court documents. A police officer sat in on the DHHS interviews, which were audio recorded, and in which Wells admitted the assaults, police said.

Wells reportedly said she was the adult and should have said no to contact with the boy. There also allegedly were other text messages, which police said Wells asked the boy to delete, saying otherwise she would go to jail.

Conviction of a class B felony is punishable by up to 10 years in prison. A class C felony conviction is punishable by up to five years in prison.

When bail is set, Wells is ordered not to have contact with anyone under the age of 18 and is ordered not to use any device that connects to the internet or any cellular device. She also will have a 10 p.m. to 6 a.m. curfew.

Bronx pair arrested in Pittston on heroin trafficking charges

Two New York men were arrested Tuesday morning in Pittston for allegedly trafficking heroin, following an investigation by the Kennebec County Sheriff’s Office.

Arrested were 27-year-old Anthony Robert Cappuccio and 25-year-old Devin Jarrell Jackson, both of Bronx, New York, according to Deputy Chief William Johnson, of the sheriff’s office.

Police made the arrest around 10:30 a.m. during a traffic stop on South Beech Hill Road, Johnson said, after investigating the two men and securing an arrest warrant. Maine State Police assisted with the arrest.

Both men were charged with aggravated trafficking of scheduled drugs and possession of scheduled drugs, said Johnson, who identified the drug as heroin. Johnson did not know the amount of heroin the men were allegedly carrying or what their bail was set at.

“This is an all day thing (the detectives) are working on,” Johnson said. “It was an ongoing investigation, and their work culminated in the arrest warrants and a traffic stop.”

Police took the men to the Kennebec County jail in Augusta, Johnson said.

Augusta woman to serve 30 months in prison on two drug trafficking charges

AUGUSTA — A woman arrested in November and January on drug trafficking charges in the city was sentenced Tuesday to 30 months in prison during a hearing at the Capital Judicial Center.

Donna Lynnette Hall, 46, of Augusta, also known as Donna Williams, pleaded guilty to the two charges of unlawful trafficking and one count of violating condition of release, and she did not contest the forfeiture of $12,188 in cash and two firearms seized during a raid at the Senator Inn & Spa.

Assistant Attorney General Katie Sibley, who prosecuted one of the trafficking charges, said Maine Drug Enforcement Agency investigators had learned that Hall had driven a co-defendant, Kashawn McLaughlin, 26, of Queens, New York, to New York in October 2015 so he could get drugs to bring back to Maine. Then on Nov. 2, 2015, agents doing surveillance on a room at the Senator Inn saw Hall coming and going several times to buy illegal drugs. A raid on that room and several other locations in Augusta that day resulted in police seizing “a significant amount of cocaine base and other indicia of trafficking” Sibley told Justice Donald Marden. However, Sibley said the charge against Hall was reduced from aggravated trafficking to unlawful trafficking because the state could not prove Hall knew how much cocaine base was present in the room. She is the third defendant to plead guilty in connection with that investigation, Sibley said.

In the other charges, Assistant District Attorney Tyler LeClair said Detective Michael Bickford, of the Kennebec County Sheriff’s Office, recorded an informant purchasing heroin from Hall on Jan. 19, 2016, in a parking lot in Augusta. Hall was free on bail on the previous charge at the time.

Hall’s attorney, Matthew Bowe, told Marden that Hall had been abused in relationships with men when she was in her teens and 20s in Louisiana, and had a depressive disorder as well as substance abuse problems. Bowe said Hall was addressing some mental health problems while being held in the Cumberland County Jail on the Kennebec County charges.

He said Hall had been living and working for a long time in Augusta before the incidents. Bowe said the 30-month sentence, which carries no suspended portion or probation, will permit Hall to return to Louisiana when she completes it.

Hall told the judge she also anticipates getting help while she serves her sentence at the Windham Correctional Facility.

“We have an awful problem in this area, ma’am,” Marden said, adding that her “positive attitude” could help her succeed. Hall was fined $400.

Also on Tuesday in the same courtroom, Stacey A. Grant, 53, of Prospect, pleaded guilty to trafficking in heroin and violating conditions of release and was ordered to serve an initial two years of a four-year prison term, with the remainder suspended, and placed on probation for three years.

Assistant District Attorney Alisa Ross said Grant had been stopped by Maine State Police Trooper Niles Krech on Dec. 14, 2015, in Augusta, and Grant, the vehicle and a passenger were searched because Grant was subject to bail conditions from Cumberland County.

Ross said Grant later admitted that two fingers (10 grams each) of heroin found in the passenger’s coat pocket were actually his and that he had bought them for $75 each for family members.

Grant’s attorney, William Baghdoyan, said the Cumberland County charge has been discussed with prosecutors there and that Grant is expecting to be sentenced to a concurrent year in prison for that drug trafficking offense.

Grant also was fined $400 and ordered to pay $120 restitution.

Baghdoyan told Marden that Grant was a veteran but not accepted into the veterans’ court program. Baghdoyan said Grant had worked as a roofer and became addicted to painkillers after receiving prescription drugs for pain resulting from a series of surgeries after he fell from a roof.

Augusta police look for home invasion suspect

Police are asking the public to help with an investigation into a report of a home invasion early Wednesday morning on Northern Avenue in Augusta.

Police say a man claiming to be a police officer forced his way into an apartment about 12:30 a.m. and demanded money and possibly drugs. He was reportedly wearing a black mask and a dark hoodie and carrying a gun, and ran away after a struggle, according to a news release issued by police Maj. Jared Mills.

Patrol officers, Maine State Police and a police dog looked for the man but were unable to find him. Mills stated in the news release that “there was no indication this was a random act” because police believe the man was looking for drugs that are known to be at that location.

At the hearing, the prosecutor said the state wants Halle to serve an initial 20 years behind bars and then be supervised for another decade. The defense can argue for a lesser sentence.

Kennebec County District Attorney Maeghan Maloney, who sat with the victim in the gallery of the courtroom as the pleas were entered, said afterward, “That case makes me wish we had life in prison as an option.”

In the meantime, she said, “it will keep him out of our community for two decades and under supervision for another decade.”

The minister of the victim’s church and some of her friends were with her as well.

The gross sexual assault charge carries a maximum penalty of 30 years in prison, Justice Donald Marden told Halle as Halle waived his trial rights. Halle, who has no previous criminal record, responded to the judge’s questions with one- and two-word answers.

Halle’s attorney, Pamela Ames, is expected to argue at a later hearing that the sentence should be lower.

After the February attack, Waterville police Chief Joe Massey cited the case as an example of why people should arm themselves.

“In cases like this, you wish the homeowner had a weapon and was capable of defending themselves,” he said at the time, drawing praise and criticism from gun experts.

In court on Wednesday, Deputy District Attorney Paul Cavanaugh recited the facts of the case at the hearing, saying Halle assaulted the woman after entering the neighbor’s home in the middle of the night by removing a window air conditioner. Cavanaugh said Halle put a pillow case over the woman’s head, sexually assaulted her, using a pellet gun that appeared to be a real gun to force her to comply, and then carried her into the shower, where he “hosed her down.”

Cavanaugh said Halle threatened to harm the woman and her family if she reported the attack.

“She said the Lord’s Prayer, and then called police,” Cavanaugh told the judge. The sexual assault was reported by the victim about 5 a.m.

Halle told police he originally broke in to steal money, and said he was too drunk to remember some details.

Police later found a discarded pellet gun and followed a trail to where Halle was staying with his sister.

Cavanaugh said no items were stolen from the victim’s home. The victim was treated at a hospital after the attack.

Halle stood in the prisoner’s dock while Cavanaugh described the events. Ames told the judge, “There are certain facts (Halle) does not recall probably because of the ingestion of alcohol.”

Cavanaugh said the state would be recommending a 30-year sentence on the gross sexual assault charge, with an initial 20 years to serve and the remaining 10 years suspended, and four years of probation.

A sentencing hearing is scheduled tentatively for Sept. 2, and in the meantime, Marden ordered Halle be held without bail.

He’s been held in lieu of $500,000 cash bail since his arrest the day after the sexual assault and burglary.

“He’s not going to get bail, Ms. Ames,” Marden said to the defense attorney after she said the state previously had attempted to extinguish Halle’s right to bail.

Cavanaugh said the state will dismiss another charge of gross sexual assault, a charge of aggravated assault and a charge of terrorizing with a dangerous weapon at the sentencing hearing as part of the plea negotiations. Halle was indicted on all the charges in April 2016.

Fairfield man pleads guilty to raping wife

AUGUSTA — A Fairfield man pleaded guilty Wednesday to raping his then-wife in April and May 2015.

Raymond R. Killam, 43, entered the pleas to two charges of gross sexual assault at the Capital Judicial Center as his former wife and her family watched.

Killam’s attorney, Andrew Wright, told Justice Donald Marden that Killam was entering the guilty pleas under the Alford doctrine, which indicates he believes a jury could convict him if the state provided the evidence it says it has.

District Attorney Maeghan Maloney sat with the victim during the hearing.

“She wants other women in a similar situation to know they don’t have to accept abuse,” Maloney said after the hearing. “They can speak up and the abuse will stop. She thinks there’s probably other women out there like her. Even when you’re married, ‘no’ still means no.”

Killam is to be sentenced in September, a time when Wright said several of Killam’s relatives can participate.

At that time, the state is expected to dismiss the remaining 10 charges in the indictment against Killam as well as several other charges brought afterward, according to the prosecutor, Deputy District Attorney Paul Cavanaugh told Marden.

Both the prosecutor and the defense attorney told Marden that there was no agreement on the penalty to be imposed, and Marden conveyed that directly to Killam.

Killam acknowledged that.

Cavanaugh said the state would be seeking a prison term that would “approach 30 to 40 years.” Wright said he anticipated arguing for something considerably less.

“This was a late decision (to plead guilty),” he said. “We are uncertain at this point what we’re going to be arguing.”

The victim agreed Wednesday to be identified as his wife. They have since divorced.

Cavanaugh said the couple had a troubled marriage, and Killam had been convicted of assaulting her and violating a protective order and had been in some domestic violence counseling.

Killam’s wife began keeping a diary of the assaults in an electronic form to prevent him from reading them, Cavanaugh said.

Cavanaugh said Killam moved out of the home after his wife sought help from friends after the attacks intensified, and at one point she went to the emergency room for treatment.

Cavanaugh said Killam initially denied intimidating her into sex and “assumed he had standing consent because they were married.”

Killam previously was convicted of a sexual assault on a previous spouse, Cavanaugh said. Records show Killam was convicted in 2005 in Androscoggin County Superior Court of unlawful sexual contact and given a suspended four-year prison sentence.

Marden ordered that Killam be held without bail pending sentencing.

Defendant in Manchester double murder case found guilty of terrorizing charge

AUGUSTA — A man being held without bail on two murder charges entered a no contest plea Wednesday to a charge of terrorizing in connection with an incident at the Kennebec County jail.

David W. Marble Jr., also known as “Dee Money,” 30, of Rochester, New York, entered the plea to the misdemeanor terrorizing charge during a brief hearing at the Capital Judicial Center. He was found guilty automatically by Justice Donald Marden and sentenced to 45 days in jail, the penalty recommended by Assistant District Attorney Tyler LeClair. The charge carries a maximum penalty of 364 days in prison.

The offense occurred Jan. 25, 2016, at the Augusta jail, and the victim of the threatening was a corrections officer.

“I believe that the corrections officer may have overreacted,” Marble’s attorney, Pamela Ames, told the judge. “But because of the pending murder charge, we do want the attorney general’s office to use it as an enhancement of sentencing.”

After the plea, there was a brief discussion about how Marble would pay the $20 victim’s fee that accompanies the conviction.

Ames said her client had no money.

“I don’t know how they are ever going to collect it,” she said.

Marden said it might be appropriate to handle it through any prisoner account Marble might have. The Kennebec County jail allows money to be deposited into inmate accounts, which can be used to pay for items through the commissary and for phone calls.

Ames also told Marden that a hearing on various motions in the murder case is scheduled for Sept. 20 before Justice Michaela Murphy, who is assigned specially to the case.

Marble was indicted in February in connection with the shooting deaths of Eric Williams, 35, and Bonnie Royer, 26, an Augusta couple who were found early Dec. 25, 2015, in an SUV parked on a dirt road in Manchester not far from their home.

Each had been shot in the head, according to the state medical examiner.

An investigation by Maine State Police indicated the murders were motivated by revenge because Marble believed Williams was among those who had burglarized Marble’s apartment just two hours earlier while Marble was being driven to the Portland area on a drug run. Several people involved in the burglary indicated Royer was not there.

The defense has sought to find out what the state promised Timothy Bragg, allegedly for his testifying that he drove Marble to and from the scene of the murder, as well as the “full name, date of birth and current address” of a person described in court documents as Maine Drug Enforcement Agency “Confidential Informant #4263,” who allegedly witnessed Bragg buying two firearms for Marble. The motion for disclosure of identity says the confidential informant gave investigators “information regarding drug trafficking, the identity of other individuals involved as well as the knowledge of David Marble Jr.’s apartment being broken into and televisions being stolen.”

Ames said she anticipated a trial early next year.

During Wednesday’s hearing, Marble was handcuffed to shackles that ran around his waist.
