Trio charged in Waterville Wal-Mart theft

WATERVILLE — Three men, including one who was wanted in connection with a drug-trafficking investigation, were arrested Wednesday morning after a report of shoplifting from Wal-Mart in Waterville Commons.

Among the three was Justin Thomas, 28, of College Avenue, for whom police had been searching in connection with a months-long investigation, Deputy Chief Bill Bonney said Wednesday. Police had arrested Ryan Farnham and Brooke Whitney on July 5 in relation to the case.

Thomas was charged with theft along with Ryan Gagne, 28, of College Avenue, after the pair reportedly were seen leaving Wal-Mart with goods that were alleged to be stolen — some $87.64 worth of items that included tools, gloves, ratchets and a seat cover, Bonney said.

The two men reportedly ran out of the store into a sedan, where Dennis Shannon, 31, of Clinton, was waiting. Shannon told police he didn’t know of any intent on Gagne and Thomas’ part to shoplift while in Wal-Mart. Police received the shoplifting report at 6:24 a.m.

The car was stopped on Central Avenue by Officer Timothy Hinton. Fairfield police also went to the scene because Hinton initially thought the three would try to flee, but they did not. The stolen items were in plain view in the car, Bonney said.

Thomas’s license was suspended and revoked and he was charged with being a habitual offender, a class C felony. He was also charged with theft, a class C felony, because he has prior theft charges.

In addition, Thomas was charged with two counts of aggravated trafficking in heroin and acetylfentanyl (a potent designer drug), a class A felony, and one count of criminal conspiracy, a class B felony, for allegedly working with Farnham and Whitney to traffic drugs.

Gagne was charged with theft, a class E misdemeanor, because he does not have prior theft charges. He also was arrested on a warrant and a probation hold.

Shannon was arrested on a probation hold because he had not been in touch with his probation officer to update his address. Shannon said he did not take part in the theft, Bonney said.

Police: Rangeley confrontation that left man dead, 2 injured may be drug-related home invasion

RANGELEY — Police on Thursday were investigating the death of one man and two others who were “severely injured” after what is believed to be an early morning home invasion at 2564 Main St. that may have been drug-related.

“There’s not a whole lot I can really get into at this point,” Lt. Brian McDonough of the Maine State Police said at a news conference at the scene shortly after noon Thursday.

The identity of the man who died is not yet known to police, including whether he was a resident of the home. Police also are not releasing the names of the two men who were injured in what they termed a “significant confrontation” in the Franklin County town in western Maine near the northern New Hampshire border.

McDonough would not give details on the nature of the injuries, other than to say they were severe. The two injured men, one of whom lived at the residence, were taken by LifeFlight helicopter to Central Maine Medical Center in Lewiston.

McDonough said the confrontation was possibly drug-related, although police are still trying to figure out what brought the other two men to the residence at 2564 Main St.

“These investigations often do have elements of drug involvement,” he said. “We can’t confirm yet that that’s the case, but it is one of the things we’re looking into.”

No one has been charged and no one is in custody, but police have questioned about a dozen people, McDonough said. Police don’t believe there is a risk to the public and would not say who reported the incident or how many people they believe were involved.

“Rangeley is a safe place,” said Rangeley Police Chief Russell French at the news conference. “It is a beautiful place. I agree that these people were more than likely picked out and the average citizen shouldn’t have problems sleeping at night.”

A town resident who asked that her name not be used said her cousin lives at the house with some other people, and she heard from family members the residents of the house were woken up around 2 a.m. by someone who “kicked down the door.” The door to the house was open late morning Thursday and smeared with blood as Maine State Police, Rangeley Police Department and Franklin County Sheriff’s Department investigated.

Her cousin, whose name she declined to give, is one of the injured men.

She wasn’t sure what happened, but, like police, speculated it was drug-related.

“In this little town you wouldn’t expect it, but yeah, it’s a bad problem,” she said as she stood at the scene of the two-story wood-frame white house on the shore of Rangeley Lake, across the street from the farmers market.

This story will be updated.

St. Albans man wanted on assault, terrorizing charges

A St. Albans man who may be armed is wanted on charges that he assaulted a woman at her home last weekend and later threatened her at her place of work, police said Thursday.

The man, Rusty A. Grignon, 34, is wanted on charges of domestic violence terrorizing, criminal threatening and terrorizing, according to a news release from Sheriff Dale Lancaster, of the Somerset County Sheriff’s Office.

The assaulted was reported to police about 12:30 a.m. Saturday at a residence on Hartland Road in St. Albans. Sheriff’s deputies met with a 35-year-old woman in Skowhegan after she had fled from her St. Albans residence.

The woman, who had injuries on her face, neck and arms, alleged that Grignon had assaulted her earlier that evening, according to the release. Deputies went to the St. Albans residence just before 3 a.m. but couldn’t find Grignon; and the woman’s car, a gray Hyundai Sonata, was gone. Police searched the area and asked other area law enforcement agencies to be on the lookout for the Grignon.

The next day, Sunday, Grignon allegedly confronted the woman at her place of work in Skowhegan, creating a disturbance in the workplace and threatening both the woman and another employee, according to the release. Grignon fled before Skowhegan police got there, the release said, and the agency has charges pending against him.

The sheriff’s office obtained an arrest warrant for Grignon on Monday in connection with the reported assault.

Police asked that anyone with information on Grignon’s whereabouts call the Somerset County Sheriff’s Office at 474-6386. The sheriff’s office recommended that the public not approach Grignon because “there is reason to believe that he may be armed,” according to the release.

Jackman man, accused of aiming gun at Somerset deputy, faces extradition to Pennsylvania

A Jackman man wanted in Pennsylvania on a repeat drunken driving allegation is to be extradited from Maine to face charges, but he also faces a felony charge in Somerset County for allegedly pointing a gun at a sheriff’s deputy in May.

Matthew Todd Mayberry, 45, of Jackman, was arrested Tuesday on a charge of being a fugitive from justice and is being held without bail while extradition papers are being drawn up, police said.

Somerset County Sheriff Dale Lancaster said local authorities received notification in May of a warrant for Mayberry from Pennsylvania, and when they went to arrest him, he allegedly drew a gun on Deputy Lucas Libby. Mayberry later was indicted on the charge, a class C felony, and court dates were set.

The charge in Pennsylvania is driving under the influence with a previous conviction. The warrant was issued after Mayberry allegedly fled that jurisdiction before he could face the new charge.

Sheriff’s deputies went to Mayberry’s home in May to arrest him.

“We went to his residence, and while we were arresting him — when he first met the deputy — he did confront the deputy with a gun,” Lancaster said.

Mayberry was arrested, but later was released because the warrant from Pennsylvania was for a misdemeanor and there is a technicality in Maine law that a charge has to be felony in order to hold a fugitive from justice, according to Lancaster.

Somerset County officials notified Pennsylvania officials that Mayberry was released, Lancaster said. Pennsylvania authorities in turn petitioned Maine Gov. Paul LePage’s office for what is called a governor’s warrant to hold Mayberry until officials from that state could come and pick him up.

The governor’s warrant came through July 21 and police arrested him Tuesday.

An intake worker at the Somerset County Jail in East Madison said Mayberry was being held without bail and is to be arraigned Friday on the fugitive charge.

Lancaster said he has not discussed the case with the district attorney’s office, so he did not know if Maine authorities plan to seek extradition of Mayberry back to Somerset County to face chargers of criminal threatening with a dangerous weapon and refusing to submit to arrest or detention, as listed in the indictments.

“I would hope, where he pointed a weapon at a deputy sheriff, that we would do that,” he said.

Documents filed in court by Staff Sgt. Michael Knight on behalf of Libby at Somerset County Unified Court in Skowhegan shed light on the Somerset County incident. Lancaster said Knight filed the documents for Libby, who was fulfilling military obligations at the time, based on the deputy’s probable cause affidavit.

Libby traveled to Jackman to arrest Mayberry on May 3 on the original fugitive charge, according to the documents. The deputy met with U.S. Border Patrol agents, and three of them accompanied him to Mayberry’s home on Main Street in Jackman.

Five dogs were outside and a man fitting Mayberry’s description was spotted about 9 p.m. running naked from an outhouse into a nearby camper.

The deputy knocked on the door and told Mayberry he had a warrant for his arrest, according to the affidavit. Mayberry allegedly refused to come out, but the door was unlocked, so the deputy pushed it open.

Libby was standing in the doorway when “Matthew came out from the bedroom area of the camper with a handgun and was wearing black body armor,” according to the court document. “Matthew had the gun up and had the gun pointed at me.”

Libby took cover, holstered his Taser and drew his own handgun and pointed a flashlight beam in Mayberry’s face. Mayberry lowered his gun “to a low ready” position. All three Border Patrol agents now had their guns drawn, according to the affidavit.

Libby ordered Mayberry to drop his weapon, but he also saw a shotgun behind him on a couch. Mayberry allegedly said, “You are not the one running the show. I am,” and he reportedly then talked about his rights, his mental state and the United Nations.

Libby and two of the Border Patrol agents managed to grab Mayberry and force him to the ground outside the camper, as Mayberry allegedly continued to resist, according to the court papers. He was taken into custody and to the jail.

A Somerset County grand jury indicted Mayberry later in May, and he was released on bail until his arrest on the governor’s warrant as a fugitive from justice on Tuesday.

AUGUSTA — A city man accused of robbing The Big Apple store on Stone Street on Monday night made an initial court appearance Friday, at which a judge set bail at $5,000.

Abraham C. Matt, 30, of Augusta, was arrested Wednesday after police reviewed surveillance video of the incident, which occurred about 11:40 p.m. Monday.

According to an affidavit by Augusta police Detective Jesse Brann, Matt “admitted he was a heavy narcotics user and that he had robbed the store to pay a drug debt.”

Matt had been held without bail before Friday’s hearing, which was held via video link between the jail and a courtroom at the Capital Judicial Center.

The suspect in Monday night’s robbery had been described as an unshaven dark-haired man wearing an Under Armour blue hooded sweatshirt, red pajama bottoms and black-and-yellow gloves. He entered the store, took a Moxie soda from the refrigerator, then demanded the clerk give him all the cash in the register.

The robber told the clerk he was serious and demanded she “hurry up,” Brann wrote in the affidavit.

The robber got about $90 in cash and exited on foot.

The clerk also said the man wore a scarflike item around his neck, possibly to cover tattoos.

The affidavit indicates no weapons were displayed. The robbery charge carries a maximum penalty of 10 years in prison.

Matt, whose address is listed as “transient” on the robbery complaint, has previous convictions for burglary and theft in Waldo County. His most recent addresses are in Augusta and Whitefield.

He was held without bail until Friday’s court appearance.

Vandals deface Winthrop lunch wagon that benefits veterans

$

WINTHROP — The mobile lunch wagon that is usually parked across from American Legion Post 40 and next to the town beach was vandalized late Wednesday night, say volunteers who run the small canteen and spend its proceeds on efforts supporting local veterans.

When Tina Bowden, one the facility’s managers, arrived at the wagon Thursday morning, she found that vandals had come at some point during the previous night and used human feces to write a crude message on the wagon, she said.

The words “Serving all veterans of all wars” are already painted on the front of the lunch wagon, but Bowden said the vandals used feces to write an expletive before “veterans” and the words “you die” after it.

The vandals also left trash lying around the wagon, tampered with a picnic table that sits next to it and unplugged the extension cord that provides the wagon’s electricity, leaving more than $100 worth of frozen and refrigerated food to spoil over the next few hours, Bowden added.

On Friday morning, Bowden and John Brennan, a Gulf War veteran who also oversees the lunch wagon, were both still appalled by the scene they encountered a day earlier.

“It’s taking from the veterans that angers me,” said Bowden. “They wrote with feces on there. That’s very disrespectful.”

“I would assume punk kids did it, but I don’t know,” Brennan added.

Bowden is a member of the American Legion Auxiliary, an organization comprised of women who support the efforts of American veterans. All profits from the wagon support the group’s year-round initiatives, including the preparation of turkey dinners for veterans around Thanksgiving and the donation of supplies to benefit local kids.

The organization is affiliated with American Legion Post 40 and the local Veterans of Foreign Wars (VFW) unit, both of which are housed across the road at 117 Bowdoin St.

On Thursday, Bowden said she cleaned the site and reported the incident to police, while Brennan spent $25 to secure the electrical outlet that sends power to the wagon. He noted that while the wholesale value of food losses was about $150, sales of the prepared food would have generated three- or four-times that amount in revenue.

The nuts and bolts on the picnic table there also seemed loose and out-of-alignment on Thursday, Brennan said, so it was replaced with another belonging to the American Legion Post.

This isn’t the first time in recent memory that a disturbance has been reported at the town beach.

After receiving a spike in complaints about people smoking, fighting and breaking other local rules, the Winthrop Police Department has been considering sending extra patrols to the lake front. Chief Ryan Frost will speak with the Town Council about that issue at its regularly scheduled meeting on Monday evening.

A gaggle of geese also took up residence on the town waterfront early this summer, creating a nuisance for beach users. The town has hired a pest service to spray repellent at the beach and on nearby Norcross Point.

But while police did take a report about the recent vandalism on Thursday, Sgt. John Hall said there is little for the department to investigate, because the mess was cleaned up by the time they arrived.

Brennan, who is also active in the American Legion Post, said the organization has a security camera trained on a utility pole about 20 feet from the lunch wagon, but the perpetrators could not be seen in any of the footage collected overnight Wednesday. The organization is now considering adding additional security cameras.

Brennan spoke with several residents who reported other disturbances around town Wednesday evening, including vandals who left scrap metal strewn about Norcross Point and drove in donuts in the parking lot there, but Hall said the police had not received any other complaints on Thursday.

New York man died of gunshot wound to chest in Rangeley home invasion, police say

The man who died in an early morning home invasion Thursday in Rangeley was a 29-year-old from New York who was shot in the chest, police said Friday afternoon.

Michael Bokun, of Manhattan, was identified as the man who died Thursday afternoon by Maine State Police and the Office of the Chief Medical Examiner, according to a news release by Steve McCausland, spokesman for the Maine Department of Public Safety. The state medical examiner’s office said Bokun died from the gunshot wound, according to the release.

Two other men were injured during the confrontation, and one of the two men was identified Friday as Hector Munoz, 48, also of New York City. Munoz was treated for a head injury at Central Maine Medical Center in Lewiston, released, then arrested on a probation violation unrelated to the Rangeley incident, according to the Friday release. He is being held at the Androscoggin County Jail.

The identity of other injured man, who was a resident of the Main Street house where the incident happened, is not being released by authorities. He remains hospitalized with injuries that are not considered life-threatening.

State police evidence technicians were in the Rangeley house Friday morning as police continued to investigate, according to the release.

Lt. Brian McDonough, of the Maine State Police, said at a news conference Thursday that the incident at 2564 Main St. was reported to the Franklin County Sheriff’s Office around 1:30 a.m. Thursday. Police said Thursday they were investigating whether the incident was drug-related, but Friday’s news release didn’t offer any new information about that.

A Rangeley resident who asked that her name not be used said her cousin lives in the house with some other people, and she heard from family members the residents of the house were awakened by someone who “kicked down the door.” The door to the house was open late Thursday morning and smeared with blood as Maine State Police, the Rangeley Police Department and the Franklin County Sheriff’s Department investigated.

Sue Lind, who operates a bed-and-breakfast across the street, said Thursday that in the 12 years she has lived in Rangeley she can’t recall anyone ever having been killed.

“It’s awfully sad,” she said. “It’s a very safe town. Kids are always running around, but of course in the summer there’s always an influx of people.”

Jackman man’s Maine felony charge will wait until Pennsylvania extradition is settled

SKOWHEGAN — A Maine charge against a Jackman man who allegedly pulled a gun on a Somerset County sheriff’s deputy in May will wait until his extradition to Pennsylvania on a drunken driving charge is settled.

Matthew Todd Mayberry, 45, was given seven days by a Somerset County District Court judge Friday to contest the order of extradition. Mayberry’s lawyer, Phil Mohlar, of Skowhegan, said the Class C felony criminal threatening charge will remain “on the back burner” until the extradition case is resolved.

Mohlar said he will file the petition to fight extradition on Mayberry’s behalf and a hearing date will be set to determine if he will be sent back to Pennsylvania. No dates have been set for the Maine charges, Mohlar said, and it’s expected Mayberry would serve time in Pennsylvania on those charges first.

District Court Judge Evert Fowle ordered Mayberry held without bail.

Mayberry appeared in Skowhegan District Court Friday afternoon via video link from the Somerset County Jail in East Madison. He was represented by Peter Barnett, acting as court-appointed lawyer of the day.

Mayberry was arrested on the fugitive from justice warrant on Tuesday. The initial warrant was issued by Pennsylvania authorities in May and when a sheriff’s deputy went to arrest him, Mayberry, dressed in black body armor, allegedly pointed a gun at the deputy.

Mayberry was arrested, but later was released because the warrant from Pennsylvania was for a misdemeanor and there is a technicality in Maine law that a charge has to be felony in order to hold a fugitive from justice, Somerset County Sheriff Dale Lancaster said this week.

Somerset County officials notified Pennsylvania officials that Mayberry was released following his arrest, Lancaster said. Pennsylvania authorities in turn petitioned Maine Gov. Paul LePage’s office for what is called a governor’s warrant to hold Mayberry until officials from that state could come and pick him up.

The governor’s warrant came through July 21 and police arrested him Tuesday.

“The governor’s warrant and the Pennsylvania issues are in line to be addressed first,” Mohlar said by phone Friday. “Once that’s done, the felony stuff here will be addressed.”

Mayberry was indicted in May by a Somerset County grand jury on charges of criminal threatening with a dangerous weapon, a Class C felony, and refusing to submit to arrest or detention, a misdemeanor. His scheduled June dates to appear in court on the indictments were put on hold until August in anticipation of the extradition warrant, which was issued last week.

The charge in Pennsylvania is driving under the influence with a previous conviction. The warrant was issued after Mayberry allegedly fled that jurisdiction before he could face the new charge.

Skowhegan man charged with sex crimes against a 15-year-old girl

SKOWHEGAN — A Skowhegan man is charged with two felonies and a misdemeanor for allegedly sexually assaulting a 15-year-old girl and sharing images of his illegal activity on a social media site.

Adam Cates, 27, was arrested Friday morning following an investigation by Skowhegan police in cooperation the State Police Computer Crimes Unit and the federal Department of Homeland Security, according to a news release from Skowhegan police.

Cates is charged with sexual abuse of a minor, a class C felony; sexual exploitation of a minor, a class B felony; and possession of sexually explicit material, a misdemeanor. The felony charges could land him in jail for more than 10 years.

State, local and federal authorities carried out a search warrant Friday morning at an apartment at 43 Silver St. after they got a tip from the National Center for Missing and Exploited Children that child exploitation images were being posted on Facebook. The information indicated that the images and the criminal activity originated in Skowhegan.

Skowhegan police traced the Internet Protocol address to the Silver Street apartment and got a search warrant. During the ensuing investigation, police learned that Cates allegedly was sexually assaulting a 15-year-old girl in Skowhegan. Investigators found images of sexually explicit material allegedly involving the girl, according to police.

Detective Sgt. Josh King of the Skowhegan Police Department said the case is a serious example of the exploitation of children.

“We’re certainly concerned that this type of activity takes place,” King said by phone Friday afternoon. “And we certainly have to rely on our federal and state partners for some of the technical expertise on this. We were able to come together and bring the case to a close and we’re very happy about that. This is certainly one of the more serious cases we’ve come across recently.”

Skowhegan police Detective Katelyn Nichols is the primary investigator on the case.

Police Chief Don Bolduc said more details on the case may be coming soon.

“This is a very serious and sensitive case and still an ongoing investigation with the cooperation of Adam Cates,” Bolduc said. “I am very impressed with the work of Detective Nichols and Detective Sgt. King, as well as the assistance from the other agencies involved and their personnel.”

Cates is being held without bail at the Somerset County Jail in East Madison pending his initial appearance, possibly next week.

Dexter woman held in lieu of $10,000 cash bond on two arson charges

SKOWHEGAN — A Dexter woman was in court Friday facing two counts of arson for allegedly setting a fire July 22 in Harmony.

Lisa Anne Woodard, 45, did not enter a plea Friday before District Court Judge Evert Fowle, who told her she could face up to 30 years in prison for the class A crime.

Woodard allegedly set one fire but is charged on two counts for allegedly intending to damage property and for recklessly endangering the lives of other people who were present, Assistant District Attorney Brent Davis said during Woodard’s arraignment via video from the county jail.

Woodard’s bail was set at $10,000 cash or $100,000 in property bond. She is to have no contact with the families who were at the scene at the time of the fire.

A dispositional hearing to reach a resolution in the case is set for Sept. 21. If there is no resolution, a jury trial will be held in November, Fowle said. The case also will go before a Somerset County grand jury to determine probable cause for a trial, Fowle said.

Woodard’s bail could be adjusted once she gets a lawyer, the judge said.
