State police charge two with trespassing at Litchfield camp

A Litchfield woman and a Millbury, Massachusetts, man were charged with trespassing after state troopers found them in a vacant camp on Pleasant Pond in Litchfield early Sunday morning, Maine State Police said in a news release on the department’s Facebook page.

Police charged 41-year-old Julie Rand and 46-year-old Steven Bonavita with criminal trespass after finding them in the camp around 7 a.m. Sunday.

Rand also was charged with refusing to submit to arrest, police said, because she “fled out the back door carrying her clothes,” while Bonavita “remained in the camp and was cooperative.”

“Rand ignored orders to stop and continued running from the scene,” the department wrote on Facebook. “She was taken to the ground by police and placed in custody, after being allowed to dress.”

Sgt. Chris Rogers and Trooper Klayton Peckham went to the camp shortly after 6:45 a.m., when a man who lived in a neighboring property reported to police that he had seen them enter the camp.

“The caller reported that he had awoken to two people sitting on his front porch,” police said. “The caller told authorities that the couple had since left to access a neighboring camp that was vacant and up for sale, and he observed them removing a window screen to gain entry.”

Court appearance postponed for Michael Hein, accused of kicking puppy on Augusta trail

AUGUSTA — A judge on Tuesday postponed a case in which a city man is accused of kicking a 4-month-old puppy in November on the Kennebec River Rail Trail.

Michael Hein, 46, of Augusta, was scheduled to appear at the Capital Judicial Center for a dispositional conference, but the case was postponed because a deputy district attorney wasn’t available. No new hearing date has been set.

News of the case’s continuance disappointed a dozen people, including the puppy owner’s family, who had gathered with signs saying, “Power to the Puppy” and “No animal cruelty.”

Hein is accused of kicking a puppy owned by AmyLou Craig while she was walking the dog on the trail on Nov. 23, 2015. Through his attorney, Scott Hess, Hein has denied the accusation. Hein has been charged with animal cruelty, a class D crime that carries a maximum penalty of 364 days in jail and a $2,000 fine.

Hess said Tuesday his client was disappointed that the case was postponed.

“The court date was not moved at his request,” Hess said. “He unequivocally denies the allegations and looks forward to the truth being presented in a court of law.”

Hess objected in court to the postponement, which was granted by Judge Tom Nale.

Hess said he understood that the hearing was continued because the prosecutor was not available. However, as the 10 a.m. hearing was approaching, Craig, her parents and others lined up coffee and doughnuts on a wall outside the Capital Judicial Center. The puppy involved in the alleged attack, Brewer, was not present for their planned protest.

“I didn’t think that would be appropriate,” Craig said. Brewer will be a year old in a couple of weeks, she said.

Craig said she was disappointed the case was not addressed Tuesday. “I’d really like to see it over and done with,” she said.

Hein is well known in local political circles as a conservative activist. He was fired from the Christian Civic League of Maine in 2010 and later took the organization to the Maine Human Rights Commission, claiming that it had retaliated against him for alleging that the group had an illegal working relationship with a staff writer. The league was later cleared of wrongdoing.

In July 2012, Hein was sentenced to serve seven days in jail after pleading guilty to a charge of willful violation of the Maine Clean Election Act. Prosecutors said Hein tried to qualify for public financing under the Clean Election Act and needed qualifying contributions of $5 each from 60 registered voters in House District 57, which at the time included part of Augusta. Hein admitted that he broke the law by paying for those contributions out of his own wallet.

In 2006, Hein made headlines by leading a protest against the use of live models in a downtown Augusta lingerie shop called Spellbound. He asked police to investigate what he described as indecent activities at the store and said he worried about school buses that passed by the windows. The store closed later that year after about a year in business.

At Tuesday’s scheduled court hearing, Laura Benedict, owner of the Red Barn restaurant in Augusta, said she joined the show of support for the dog after reading on Facebook about what happened. Benedict said she has dogs of her own and was “outraged” by the alleged attack.

Craig’s father, Lou Craig, owner of College Carry-Out in Augusta, where a large sign has urged “Justice for Puppy Brewer,” thanked all those for coming to show support for Brewer and AmyLou Craig.

District Attorney Maeghan Maloney also talked to those gathered outside the courthouse to explain that her office requested the case’s continuance because Deputy District Attorney Paul Cavnaugh, who is assigned to the case, was on vacation.

“I let them know the case has been assigned to our most experienced attorney,” she said. “It’s the only continuance we’ve requested.”

She also said she expected that the case will go to trial and that this would not necessarily delay that, since the court prioritizes trials for those in custody as well as sexual assault and domestic violence cases.

Augusta police charged Hein following an investigation that included statements from several witnesses. Police said the dog was on a leash, moved in Hein’s direction as he jogged toward it, and Hein stopped and kicked the dog.

Craig said shortly after the attack that a jogger had threatened to kick the dog if Craig did not shorten its leash. She said she did not shorten the retractable leash immediately because she didn’t want to yank on the dog’s neck. She said the dog was no less than 3 feet from the jogger. Craig said the dog flew about 4 feet into the air after it was kicked, and the dog recovered.

Waterville woman arrested on charges of assault, threatening with weapon

WATERVILLE — Police arrested a woman Monday at her apartment on Spring Street, charging her with a felony and misdemeanor for allegedly threatening her partner over a period of two days.

Dina Passno, 37, of Waterville, was arrested on charges of assault and criminal threatening with a weapon, a class C felony; and domestic violence assault, a class D misdemeanor. The charges could result in up to six years in jail and fines of up to $7,000.

Police responded to a call reporting the incident around 7 p.m., said Deputy Chief Bill Bonney, of the Waterville Police Department.

Bonney said Tuesday that Passno and her partner had been in an ongoing disagreement for two days, during which time Passno allegedly threatened to stab her partner with a knife multiple times.

Passno also reportedly had hit the door with the knife while her partner was on the other side; Bonney said police found marks on the door from the knife. Passno’s partner had minor injuries that did not require immediate medical attention, police said.

Passno was being held in the Kennebec County jail in Augusta until she can appear before a judge, who will set bail, That probably will happen Wednesday, Kennebec County District Attorney Maeghan Maloney said.

Passno is scheduled to appear in court Aug. 8.

Waterville man reported to have been stabbed on Moor Street

WATERVILLE — Police are investigating the circumstances surrounding the reported stabbing of a 21-year-old man around 6 p.m. Tuesday on Moor Street.

Robert Carson, of Waterville, claimed he had been stabbed in the stomach outside of the Moor Street home where he had been staying with a friend’s family, according to homeowner Leiza Ruest, the mother of Carson’s friend.

Police at the scene couldn’t release any information about the incident, stating they were still working to figure out what exactly had happened.

Carson was conscious when he was taken away from the scene in an ambulance, Ruest said.

Ruest said she was in her home when the incident occurred, and she did not see what happened. However, she said she could hear an argument outside between Carson and a group of people she said lived a couple of houses away from her.

When she went to the front of the house to see what had happened, she said, Carson was grasping his stomach and said he had been stabbed.

Police seek woman who allegedly stabbed neighbor in Waterville

WATERVILLE — Police are looking for a woman who allegedly stabbed her neighbor in the stomach on Moor Street in the city’s South End Tuesday night, sending him to the hospital with serious injuries.

Police later charged three people with an assault at the same location. Those charged believed the woman they allegedly assaulted, who sustained minor injuries, had helped police in the stabbing investigation, according to Deputy police Chief William Bonney.

Bonney said Wednesday that police determined that Ashley Boivin, 32, stabbed the 21-year-old man, whose name is not being released. They both live on Moor Street, which is off Water Street. The victim, who was conscious and alert, was taken Tuesday night to MaineGeneral Thayer Center for Health with injuries that are not life-threatening and then transferred to MaineGeneral Medical Center in Augusta, where he was in the critical care unit Wednesday and his condition had been stabilized, according to Bonney.

The stabbing occurred around 6 p.m. Tuesday during a verbal altercation on the street between several parties, according to Bonney. The confrontation between Boivin and the victim turned physical and she allegedly stabbed him and fled the scene, he said.

Bonney said there was no one reason for the altercation — that disputes in the neighborhood have been ongoing.

He said Boivin is being sought for charges related to elevated aggravated assault, a Class A crime punishable by up to 30 years in prison. A charge is elevated when a person intentionally or knowingly causes serious bodily injury using a dangerous weapon.

At 10 p.m. Tuesday, police returned to the same location on Moor Street where a woman, 19, was allegedly assaulted by three people who had been involved in the verbal dispute earlier in the night and apparently believed she had helped police in the stabbing investigation. The victim suffered minor injury and did not require treatment, according to Bonney.

Colby Dyer, 26, was arrested and charged with domestic violence assault, a Class D misdemeanor, as he was in a relationship with the victim; JennyLee McLean-Miller, 31, and Priscilla Pagliaroli, 20, were both summoned and charged with assault, a Class D crime in connection with the incident, according to Bonney. Mug shots of McLean-Miller and Pagliaroli were not available because they were summoned, not arrested.

Colby is scheduled to appear in Waterville District Court Aug. 2; McLean-Miller and Pagliaroli are to appear in the same court Oct. 4, Bonney said.

Police do not believe Boivin presents a threat to the community, but asked that anyone who sees her or has contact with her call the police department at 680-4700 to speak with Detective Joshua Woods.

Four plead guilty to Dexter area drug conspiracy

Four men, including two from Harmony and one from Dexter, pleaded guilty Wednesday in U.S. District Court in Bangor in a drug conspiracy case in the Dexter area investigated by the U.S. Drug Enforcement Administration and the state Drug Enforcement Agency.

The Dexter Police Department and the Penobscot and Piscataquis County sheriff’s offices also assisted in the case.

Mark Tasker, 49, of Dexter; Greg Tasker, 28, of Stetson; and Eugene Moulton, 57, and Antoinette Perreault, 48, both of Harmony, pleaded guilty on charges of conspiring to distribute oxycodone and cocaine, as well as possession of the two drugs with the intent to distribute.

Court records show that the four distributed oxycodone and at least 11 pounds of cocaine in the Dexter area between January 2002 and November 2014, according to a news release from U.S. Attorney Thomas E. Delahanty II. The drugs were acquired in Rhode Island before coming into Maine.

Mark and Greg Tasker, a father and son, according to the news release, were found to have distributed both drugs. Mark Tasker also pleaded guilty to maintaining a drug-involved premises, as he let his residence on Liberty Street in Dexter be used to distribute the drugs.

Moulton and Perreault were found to have distributed cocaine.

The release did not say whether a sentencing date had been scheduled.

Mark Tasker faces 10 years to life in prison, five years to life on supervised release and a $10 million fine on the conspiracy charge. On the premises charge, he faces up to 20 years in prison, three years of supervised release and a $500,000 fine.

Greg Tasker, Moulton and Perreault all face up to 20 years in prison, from three years to life on supervised release and a $1 million fine.

On Jan. 25, four co-defendants also pleaded guilty in the case. John Williams, 43, of Stetson; Cynthia Williams, 42, of Stetson; Whitney Chadbourne, 22, of Harmony; and Corey Pomerleau, 24, of Harmony, await sentencing.

The eight were among 10 arrested in April 2015 in connection with the conspiracy, and prosecutors asked they be held without bail.

Somerset County commissioners renew police contract with Madison

SKOWHEGAN — Somerset County commissioners voted unanimously Wednesday to renew a contract with the town of Madison to provide police services through the Somerset County Sheriff’s Office.

The contract, which renews the agreement for police services for one year, includes new language that allows the town to be reimbursed for training costs if one of their deputies is moved to another part of the sheriff’s office. It was approved by commissioners 4-0 Wednesday with no discussion. Commissioner Phil Roy was absent.

State law allows municipalities to be reimbursed for training costs if an officer moves to another department within five years of his or her training. Even though the former Madison Police Department was absorbed by the Somerset County Sheriff’s Office last year, there is still a separation between the two with the town paying the county to cover all policing services, including training costs.

“What we wanted put in there specifically was if, say one of our deputies was trained and paid for by the town of Madison and then that deputy took another position, say up in the unorganized territory, in that situation the county would reimburse the town,” Madison Town Manager Tim Curtis said.

After the sheriff’s office assumed control of operations in Madison last year, one deputy took an open position elsewhere in the county, Curtis said. The town was not reimbursed for the deputy’s training, which had taken place within the last five years and was paid for by the town.

“Technically, we could have asked for that $8,000 or $10,000 worth of training costs, but we chose not to,” Curtis said. “Instead of doing that, we asked for this new language to be included in the contract.”

The cost of sending an officer to the Maine Criminal Justice Academy and paying for someone to fill in while the officer is away at training is about $35,000, according to Somerset County Sheriff Dale Lancaster. The town of Madison is scheduled to pay $485,000 over the course of the 2016-2017 year for police services, about a $90,000 savings from the budget for the Madison Police Department.

Although the contract was approved officially by commissioners Wednesday, it has been in place in the town since the first contract expired July 1, Curtis said.

Justin Pillsbury sentenced to 50 years in prison for killing Jillian Jones in Augusta

AUGUSTA — The man who killed Jillian T. Jones by stabbing her 12 times — twice through the neck — will likely spend the rest of his life in prison.

Justin Pillsbury, now 41, formerly of Augusta and Benton, was sentenced Thursday at the Capital Judicial Center to 50 years in prison in connection with the murder of his girlfriend, Jones, on Nov. 13, 2013. He was convicted March 17 in the same courthouse.

Pillsbury testified at his jury trial in March that he acted in self-defense, stabbing 24-year-old Jones only after she came after him with a knife. He claimed Jones cut him above the eye and on the hand and forearm as he tried to disarm her that evening during an argument over her cellphone.

Pillsbury said at trial he had been drinking most of the day, was intoxicated during the attack and said he “didn’t intend to kill the love of my life.”

On Thursday, he apologized to her family and her friends, many of whom were sitting in the courtroom.

“For every person in this room with a tear in their eye, I put it there and I accept responsibility,” Pillsbury said.

“I’m so sorry that I killed Jillian,” he said, half-turning to Jones’ family in the courtroom. “On that night I made a tragic mistake.”

The prosecutor, Assistant Attorney General Donald Macomber, recommended Pillsbury be imprisoned for 55 years. Defense attorney Stephen Smith, in his sentencing memo submitted to the court, recommended a 30-year term.

Jones’ body was found slumped against the bathroom wall in a Crosby Street apartment in Augusta rented by Michael St. Pierre. Pillsbury and Jones, who grew up in Bingham, had been staying there so Pillsbury could be closer to his job in Augusta. Jillian Jones was attending beauty school in Waterville at the time of her death.

“I can only imagine the fear that she felt as she stood on the other side of that bathroom door, knowing that her life was about to end,” Macomber said.

Laura Jones, Jillian Jones’ mother, spoke of Jillian Jones in the present tense as she described her, saying, “I believe she is alive and well in heaven.”

She said Jillian Jones had struggled with depression and substance abuse, but was ready to move forward, excelling at cosmetology school to be able to support herself and her daughter, Brooklyn. Brooklyn, now 6 years old, is to be adopted soon by Laura and Danny Jones, Jillian Jones’ parents, Laura Jones said.

Jocelyn Jones, two years older than her sister Jillian, described her as “an incredible mom, a loyal friend, a loving sister, daughter, auntie and granddaughter.”

Jocelyn Jones told the judge she is still in pain from the loss of her sister.

“When I was told how Justin murdered my sister, my pain intensified,” she said. “I hate that she was alone. The fear she must have felt is unimaginable and continues to haunt me. And then when I realized the missed call I had from her at 8 p.m. the night before was just a few minutes before she took her last breath, I lost it.”

She paused several times during her remarks, overcome by sobs.

GRANTING FORGIVENESS

Danny Jones, Jillian Jones’ father, said he had spoken with Pillsbury only once. That was on July 4, 2013, four months before the killing.

“Justin came downstairs and said to me, word for word, ‘Mr. Jones, I just want you to know I would never do anything to hurt your daughter,'” he said.

Laura Jones told the judge, “I pray daily for the grace to forgive the unforgivable.”

Jillian Jones’ oldest brother, Jeremy Jones, said the holidays are difficult for his family, as are celebrations of other milestones.

“All of those days were taken from us by an insecure man who supposedly loved Jill,” Jeremy Jones said. He said faith in God has helped the mourners cope.

“Jilli had forgiven so many people that have wronged and hurt her, and I know in my heart that she would forgive him today if she was still here,” he said.

Jeremy Jones said he has forgiven Pillsbury as well.

Pillsbury stabbed himself in the neck shortly after stabbing Jones, and St. Pierre testified — under a grant of immunity from the state — that he had helped sharpen the knife for Pillsbury before seeking help.

At his trial, Pillsbury said, “At that point I was overcome with grief — not guilt, grief.”

Pillsbury’s sister, Eliza Darlene Alborano Cochran, told the judge that her brother has expressed remorse and shown he’s trying to improve himself while in prison.

She said she will move back to Maine to be part of his support system, and “I’ll be here for his sons.”

The two boys were in the courtroom watching Thursday’s hearing but did not speak to the judge. Smith said Pillsbury hopes they learn from it.

CRIME AND TRAGEDY

Macomber, the prosecutor, told the jury at trial that Pillsbury was jealous of Jones’ interactions with other men. He said Pillsbury had taken Jones’ cellphone to see whom she had been communicating with, and Jones fought him to get it back when the dispute turned deadly.

On Thursday, Justice Michaela Murphy told those in the courtroom that she recognized that any sentence she imposed would essentially mean life in prison for Pillsbury because of his age, at 41.

“What happened was a tragedy, not a crime,” Smith, the defense attorney, said after the sentencing hearing. He said there will be an appeal of both the conviction and the sentencing. “Justin accepted responsibility for killing her; he didn’t murder her.”

Also outside the courthouse, Macomber said the 50 years was “a very significant sentence,” just five years short of what the prosecution had sought.

“Our heart goes out to the Jones family,” he said. “I think the court recognized how important their testimony was to bring the true Jillian to the public.”

Before any of her family members spoke to the judge, a silent video of numerous pictures of a smiling and sometimes playful Jillian with family and friends was played on the two large television monitors in the courtroom as well as on monitors on the judge’s bench and at the attorneys’ tables. Pillsbury watched as the photos came up one after the other, interspersed with an occasional quotation from the Bible. Macomber, who introduced it, said it was played at Jillian Jones’ funeral.

As the video played, members of Jones’ family dabbed at their eyes with tissues.

After the sentencing hearing, Macomber said the case involved both extreme cruelty on Pillsbury’s part and domestic violence.

“This (highlights) why we have to eliminate domestic violence in our state,” Macomber said.

To Smith’s description of Pillsbury admitting “killing” Jones rather than “murdering” her, Macomber said, “You can flip a coin to describe how Mr. Pillsbury feels. There was the early stage of remorse, then on the stand he blamed Jillian Jones for her own death; now he’s sorry.

“We’ll see which side of the coin falls when he takes an appeal.”

Former Waterville man charged with furnishing marijuana, alcohol to minors in Kingfield

A former Waterville man accused of furnishing marijuana and alcohol to two 16-year-old girls in May in Kingfield was arrested Wednesday, the second man charged in the incident.

Scott Leo, 27, with a last known address in Waterville, was arrested on two felony charges of aggravated furnishing of scheduled drugs, two misdemeanor charges of furnishing liquor to minors and a violation of condition of release.

The Franklin County Sheriff’s Office issued a warrant for Leo’s arrest on the charges in June. He was arrested by Somerset County deputies Wednesday and taken to the Franklin County Jail, where he is being held in lieu of $2,500 cash bail.

Scott McLean, 24, of Kingfield, was arrested June 2 on similar charges in connection with the May incident. McLean is charged with two felony counts of aggravated furnishing of scheduled drugs, two misdemeanor charges of furnishing liquor to minors and a misdemeanor charge of furnishing a place for minors to consume alcohol. He was released on cash bail that day and was arrested again the following day on charges of violating conditions of release, according to the jail.

After receiving a complaint from the mother of one of the two girls on May 29, the sheriff’s office launched an investigation into the May 29 incident, according to an affidavit from Cpl. Kevin Hartley, of the sheriff’s office.

Leo and McLean met the two girls, who were baby-sitting in a park, and invited the girls back to McLean’s Mill Street apartment, where they allegedly gave the girls Fireball whiskey, Twisted Tea and marijuana, according to Hartley’s affidavit.

In interviews with Hartley and Detective Steven St. Laurent, both girls admitted having consumed the alcohol and taking “several hits” of the marijuana, according to the affidavit. Leo allegedly held the marijuana pipe in front of the girl and “she felt forced to smoke,” the affidavit said.

The affidavit also stated that during the interaction Leo allegedly touched one of the girls in an “inappropriate manner that did not meet the state statute for a crime.”

On Wednesday, a Franklin County judge set Leo’s bail at $2,500 cash or a pretrial contract. He is being held at the Franklin County Jail and is scheduled to appear in county on Aug. 30.

Two Waterville cemetery fires believed to have been set

WATERVILLE — Two brush fires that ignited Thursday in Pine Grove and St. Francis cemeteries, off Grove street in the city’s South End, may have been set, a Fire Department official said.

“We’re looking at possibly someone setting these two fires,” said fire Capt. Rodney Alderman, who was at the scene. “We’ll give the fire marshal a courtesy call to see if they’re going to do anything about it. We have a person of interest.”

The fires were extinguished quickly and police were scouring the area, looking for the person who may have set them.

The first fire, at the south end of Pine Grove Cemetery, was reported at 12:57 p.m. A grounds crew from the city’s Parks and Recreation Department working in the cemetery saw smoke, hurried toward it, discovered a burning pile of leaves and brush and called the Fire Department. Firefighters arrived quickly and put the fire out.

Later, at 1:47 p.m., another fire was reported about 300 yards away in the south end of the adjacent St. Francis Catholic Cemetery. Two parks and recreation workers saw the fire, hooked up a hose from their truck to a nearby faucet and put that fire out before firefighters arrived, according to Alderman.

The material burned at St. Francis was a pile of brush about 20 feet by 10 feet in size. The brush apparently had been dumped illegally in the cemetery, according to cemetery director Mike Hebert, who was on vacation Thursday but was called to the scene by his employee, groundskeeper Sean Lawrence.

Lawrence said he was in the St. Francis office, about a quarter-mile from the fire scene, when someone visiting the cemetery told him there was a fire at the cemetery’s south end, abutting the woods. Lawrence called the Fire Department. Waterville police Officer Steve Brame arrived at the cemetery, looking for whoever might have started the fires.

Hebert said people often dump brush and other debris in the cemetery in the evenings and on weekends.

Later Thursday, parks and recreation employees Frank Waterman, Colby Ryder and Scott Fletcher were doing grounds work at Pine Grove Cemetery. They said that when Waterman saw smoke coming from the first fire, they investigated, found the fire and Ryder called the Fire Department.

“As dry as it’s been, I couldn’t believe it didn’t spread quicker,” Fletcher said. “Quite the afternoon.”

Deputy Chief William Bonney, of the Waterville Police Department, said police were investigating the case, but he did not have an update on their progress late Thursday afternoon.
