Traffic accident in Augusta leads to arrest on drug trafficking charges

AUGUSTA — A New York City man was arrested on drug trafficking charges Thursday night after a police officer observed the vehicle he was driving on Commercial Street strike a parked car. Police officers then discovered 50 grams of heroin, 20 grams of crack cocaine and an unidentified amount of cash inside the man’s vehicle, according to a press release from Deputy Chief Jared Mills.

Police also discovered the man allegedly was operating his car without a driver’s license.

Barrington Walker, 23, of New York City, was arrested on charges of aggravated drug trafficking of scheduled drugs, operating a vehicle without a license and criminal forfeiture of property. He was taken to Kennebec County jail. His bail has been set at $25,000.

Officer Robert Mathieu made the arrest after noticing that Walker, who was allegedly driving erratically, struck a parked car, according to Mills. With assistance from Officer Gregory McCarthy, a member of the Maine State Police and a police dog, Mathieu then found the drugs and cash, Mills said.

“This is our department’s latest example of how we are removing drugs that are coming into our city from out of state one case at a time, due to the heightened awareness, training and experience of Officers Mathieu and McCarthy, along with our partnership with the Maine State Police, the prevention of drug sales, the prevention of a possible drug overdose along with the formal criminal charges against Mr. Walker have achieved,” Mills said of the arrest.

Somerset County officers recognized by Maine Sheriffs’ Association

A Somerset County Sheriff’s Office deputy who alerted a Clinton homeowner to a fire and a corrections officer who intervened in an inmate’s attempt to commit suicide at the Somerset County Jail, saving the man’s life, were recently recognized by the Maine Sheriffs’ Association with awards, according to a press release from the Somerset County Sheriff’s Office.

Deputy Toby Blodgett received a citation of valor at the sheriff’s association annual banquet March 24 and Corrections Officer Edward Jacques was named corrections officer of the year for 2015, according to the release.

Jacques was at work on March 17, 2015, at the Somerset County Jail and was making a security round when he saw an inmate lying on his stomach in one of the jail’s 72-hour holding areas. Jacques had a feeling that “something just didn’t look right” and upon closer examination noticed what appeared to be a sheet wrapped around the man’s neck, the release said.

He attempted to rouse the man by calling his name and rapping on the cell door. When he didn’t respond, Jacques noticed the other end of the sheet was tied to the upper bunk.

Jacques announced a code blue over the jail radio, summoning an emergency response from security and medical staff. Upon entering the cell he found the inmate had tied the sheet around his neck and was being strangled by it, the release said.

With assistance from security and medical staff, the sheet was cut from the inmate’s neck and he began breathing and eventually talking to staff.

After a medical evaluation the inmate, who was not on suicide watch at the time, was relocated to a high-risk cell.

“Officer Jacques, through his keen observation, diligent attention to safety and security and subsequent response to a medical emergency, first-handedly saved the life of someone who otherwise might not have seen the next day,” the release said. “The values and actions of Officer Edward Jacques exemplify his dedication to his organization and the traits valued by our profession.”

In a separate incident, Deputy Blodgett was returning home around 4 a.m. on Aug. 16 after a busy overnight shift when he saw a glow in the sky and followed it to John Deere Drive in Clinton, the release said.

“Even though Deputy Blodgett had been out all night, was nearly home, and was no longer in his patrol area, he decided he needed to investigate,” the release said. Clinton is in Kennebec County.

Blodgett found a garage at 15 John Deere Drive on fire with the flames endangering a nearby house. Because of the intense heat of the fire, he couldn’t get near the house and wasn’t sure if anyone was inside, the release said, so he drove onto the lawn and activated his emergency lights and siren in an attempt to wake up anyone inside.

The noise alerted the homeowner to the fire and he and his dog got out safely.

“But for the actions of Deputy Blodgett, the fire would have extended into the man’s home within a matter of a few minutes to the point the man would have been unable to escape,” Investigator Kenneth MacMaster of the Office of the Maine State Fire Marshal said in the release. “It is my true belief that if Deputy Blodgett did not take the actions he did, the man’s exits would have been blocked by fire and smoke and the fire marshal’s office would be investigating a fatal fire.”

Norridgewock game warden is warden of the year

A Norridgewock game warden who has worked in the area since 2010 was recently recognized as the 2015 Game Warden of the Year for his “proactive approach to warden work that goes above and beyond,” according to a press release Friday from the Maine Warden Service.

Tom McKenney started his career with the warden service in the Ripogenus Dam district, where he worked for nearly four years before moving to the Norridgewock district in 2010, the release said.

He was recognized as the 2015 Maine Game Warden of the Year at a ceremony this week at the Winslow Veterans of Foreign Wars post. The annual awards ceremony this year marked the 136th anniversary of the warden service in Maine and also highlighted other Maine wardens and those who assist them in their work, the release said.

“From the moment that Tom started his career as a Maine game warden to the present day, he has been the epitome of hard work and consistency,” it said. “Regardless of the season, time of year or weather, he starts out every day striving to make a difference and be a positive hard-working member of his section and of the Maine Warden Service.”

Also recognized at the Maine Warden Service annual awards ceremony this year were the following:

K9 Search and Rescue of the Year Award: Warden Jeremy Judd and dog Tundra, Mechanic Falls.

K9 Conservation Case of the Year Award: Warden Kris MacCabe and dog Morgan, Wilton.

Waterville man charged in art show heist

A Waterville man has been charged with stealing a drawing from an art show at the Waterville Public Library, a “happy ending” that can be credited to an alert library patron and staff, police Deputy Chief Charles Rumsey said.

Jason Stephenson, 40, of Waterville, told police Friday after the drawing was found in his apartment that he took the drawing “Alive in the Darkness,” created by his cousin, Brian Vigue, as a practical joke and meant to pay for it.

Stephenson, of 21 Elm St., Apt. 3, was still summoned on a theft charge and banned from the library, Rumsey said. The drawing was priced at $300.

Vigue’s black and white graphite drawing was stolen from the Waterville Public library Thursday, where it was on display with hundreds of other works as part of the Maine Open Juried Art Show.

Vigue was relieved when he got the message from Waterville police late Friday afternoon that his drawing had been discovered. “I think a good job was done by all,” he said.

Rumsey said the drawing wasn’t damaged and was “in the condition that it was in when it was taken.”

The library staff was told by a library patron that he had been talking to a man who was admiring the drawing shortly before it disappeared Thursday.

“He was very interested,” Rumsey said. “He said how much he loved it and how great it was.”

When the library patron described the man to the staff, they recognized the description.

Stephenson had been seen hurrying from the library Thursday afternoon, wearing a coat long enough to conceal the 12-inch-by-16-inch drawing, Rumsey said.

Police, it turned out, knew Stephenson too. Rumsey said the department “is very familiar with him.”

Stephenson appears in Morning Sentinel police and court logs going back several years on drug, motor vehicle and sex offender registry charges.

Stephenson wasn’t home when police arrived at his apartment, but a person who was there, when told what the police wanted, found the artwork and gave it to police, Rumsey said.

Vigue said it was a “bombshell” when he found out that Stephenson had been charged with the theft.

He said they are not close. “We kind of lost track back when we were kids. We went our separate ways,” Vigue said. “When I run into him around town I don’t tell him much.”

Vigue said earlier Friday that the theft was especially disheartening because it’s the latest in a string of trying events for him and his wife, Amy Cryway, who own the The Framemakers.

In May, their shop at 46 Main St. sustained damage after a severe thunderstorm ripped through Waterville. The storm caused a pipe to burst, resulting in water damage throughout the shop, which caused a laptop to explode, sparking a small fire.

In April 2014, the front window of their shop was smashed and cost $5,000 to replace.

“Alive in the Darkness” took Vigue four months to complete and has an assessed value of $300. The 12-inch-by-16-inch drawing depicts a woman holding a gargoyle, with a gray mat and a silver metal frame.

“We don’t often handle this type of theft,” Rumsey had said earlier Friday. Until the break from the library patron, the department had gotten no leads despite a post on their Facebook page seeking information.

He said after the drawing was found that police were happy to be able to help Vigue and Cyrway as well as the library, who are all important parts of the community.

Library Director Sarah Sugden said Friday the drawing was believed to have been taken around 3 p.m. Thursday based on the last time it was seen by library patrons and when it was discovered missing by library staff. The theft was reported to police shortly before 4:30 p.m.

“Waterville is a really caring community, where people notice what happens,” Sugden said Friday. “Everybody is really angry about this. A theft of this nature really takes from our whole community.”

About a month ago a photograph depicting a historic scene of Waterville was stolen from a wall at the library. It hasn’t been recovered.

Sugden said that theft of library materials is “fairly common” in libraries across the country. However, she said that what made this theft strange and more discouraging was that the artwork was stolen from an exhibit.

“The library wants to be a place where artists can showcase their work and feel safe,” Sugden said.

Sugden said that in the wake of the theft, the library is working on developing new security measures. However, she wouldn’t comment on what they would be.

Stephenson was issued a criminal trespass notice that he can no longer enter the library.

Vigue said earlier Friday he is in the early stages of developing a mural for the back of The Framemakers’ shop facing the Concourse, the whole idea coming from his desire to bring public art to the Waterville area.

“I’ve been discussing some public art, and right now I’m feeling a little gun shy about it,” Vigue said before Stephenson was named as the suspect. “There is this part that what if I spend three months on this thing and the next day it is defaced?”

Winthrop police and first responders to speak on drug crisis Thursday morning

WINTHROP — Several of the town’s public safety officers will deliver a presentation Thursday morning about how residents can help respond to the drug crisis that has been affecting the state and region.

“We need help,” said Chief Ryan Frost of the Winthrop Police Department, referring to the ability of citizens to either recognize criminal activity and alert police to it, or get their loved ones who use drugs to seek treatment.

While heroin has been an issue in Maine, Frost said he also worries about the illegal use of other drugs such as cocaine and marijuana.

Speaking at the Thursday event are Frost, Detective Peter Struck and Winthrop Ambulance Chief John Dovinsky. The event is part of a monthly breakfast discussion series offered by the Winthrop Lakes Region Chamber of Commerce. It will run from 7:15 to 8:30 a.m. at the Winthrop Commerce Center.

Admission to the event is $7 for chamber members and $10 for nonmembers. Attendees do not need to sign up ahead of time.

In a preview of the talk they will give Thursday, Frost said that Struck, who investigates many of the town’s drug cases, will inform citizens about the relationship between drug use and property crimes such as burglary. The officers will notify attendees how to recognize that someone could be using drugs and ask that they call the police department with any tips that could help them solve crimes.

They will also make attendees aware of the treatment options available to drug users. In general, Frost said, his department tries to steer drug users to treatment whenever possible.

As the director of an ambulance service that serves numerous area towns, Dovinsky has a particularly close view of the toll it takes, Frost pointed out.

While there have been overdoses in Winthrop this year and last year, Frost said that none have been fatal. He also said the town’s overdose rate has been steady for the last couple years, not accelerating.

Even so, Frost said of addiction, “It’s a struggle for families. It’s an alarming thing.”

Waterville assisted living residence fire was arson

WATERVILLE — A fire in a residential assisted living center on Pleasant Street Sunday was a case of arson, according to a state fire official.

“It is considered an intentionally set fire,” said Sgt. Ken Grimes of the state fire marshal’s office.

Grimes said Monday that a suspect has been identified in the fire, but he would not release information about how the fire was set.

“We are going to be conferring with the district attorney’s office on the next steps to proceed,” he said.

The fire was reported at 7:56 a.m. Sunday at a home operated by Motivational Services Inc., an Augusta-based organization that provides services and programs for people with mental illness. Five people were evacuated from the home to which firefighters responded.

The fire was contained to just one room, according to Grimes.

“It was a small fire with minimal damage,” Grimes said Monday. “The sprinkler system did its job and held the fire at bay and, in fact, extinguished it before the fire department arrived.”

Grimes called the fire a “room and content” fire, which means it was contained to one room and its contents and did not spread throughout the building, he said.

The fire was the third arson to occur in Waterville in a week. On March 27, a pickup truck parked at 43 Elm St. was destroyed by fire, and five minutes later a fire was reported in a closet just inside the entrance to an apartment building at 58 Silver St. about 100 yards from the truck fire.

State fire investigators also were called to investigate those fires.

“We’re still picking away at that as we have time,” Grimes said of the fires.

Asked if the Elm and Silver street fires are related to the fire on Pleasant Street Sunday, Grimes said they are not.

“Officially, there’s no indication that they are,” he said. “We believe that the fire yesterday was a unique incident to that location.”

A week before the Elm and Silver street fires, an Oakland mobile home was destroyed by fire at 431 Trafton Road near the Waterville city line. Grimes said at the time that the fire was set outside the home and the homeowners were away for the winter.

Winthrop man who drove into home of then-girlfriend jailed for 146 days

AUGUSTA — An older man who crashed a Corvette into his then-girlfriend’s house last June and led police on chases through several towns was sentenced Monday on a number of charges relating to those events during a hearing at the Capital Judicial Center.

Edwin Munson, 68, of Winthrop, who made headlines previously for having wayward cattle in Readfield, was ordered to serve an initial 146 days in jail, with the remainder of the four-year sentence suspended. He was placed on probation for two years, and that is to be followed by a one-year period of administrative release imposed for a terrorizing offense. If he violates that release, he could be ordered to serve an additional 364-day sentence that was suspended.

Munson’s driver’s license was suspended for 30 days as well, and he was ordered to pay $3,087 in restitution, and fined $1,150.

Munson had pleaded guilty to two counts each of eluding an officer, and aggravated criminal mischief, and one count each of driving to endanger and terrorizing. One count of driving to endanger was dismissed. All the charges were related to events occurring on June 3, 2015, in Gardiner, Litchfield and Winthrop.

Munson was arrested that day after driving the vehicle into the ground floor of the Annabessacook Road house in Winthrop.

According to investigators at the time, troopers had gone to the Litchfield home of the woman’s son in response to reports that Munson was screaming threats to burn down the man’s house and shoot him. However, Munson left in the Corvette when told that police were on their way.

Troopers saw the vehicle on Route 126 in West Gardiner and stopped it there, but Munson sped off and avoided a road block by making a U-turn and then rammed a state police cruiser and struck a second.

Winthrop police spotted the car 30 minutes later on Main Street in Winthrop and sought to stop it there.

However, Munson then fled onto Highland Avenue, traveling briefly on U.S. Route 202 and then heading south on Annabessacook Road, entering the driveway of the home he shared with his then-girlfriend. Munson sped up the driveway, crashing into the side of the building, Winthrop police said. No one was home at the time.

In September, while the charges were pending, the woman’s family formally objected to any change in bail condition that would permit Munson to be near her or her family.

Munson has generated publicity in recent years for his dispute with the town of Readfield about his loose cows wandering onto public roads. In 2013 Munson was ordered to pay $2,500 after Readfield took Munson to court. Munson acknowledged in the judgment that his cattle had wandered from his pastures and either crossed the roads or trespassed on private property, resulting in at least eight violations of the state animal trespass law from Sept. 4, 2012, to May 26, 2013.

He subsequently was fined $50 last August for a conviction of animal trespass May 24 in Readfield. That charge came after a car hit one of Munson’s loose cows. The cows were removed later.

In a separate hearing also Monday at the Capital Judicial Center, April M. Dupont, 37, of Farmingdale, was sentenced on charges of unlawful trafficking in heroin, operating while license suspended or revoked and violating conditions of release. All the offenses occurred Nov. 4, 2015, in Augusta.

She was ordered to serve an initial 30 days in jail and the remainder of the three-year sentence was suspended and she was placed on two years of probation. Dupont also was fined $900.

An additional charge of unlawful trafficking in heroin on the same date was dismissed in exchange for the plea.

Former Maine prosecutor seeks lesser sentence on child pornography convictions

A former top drug prosecutor for the state maintains that his 165-month sentence for receiving, transporting and possessing child pornography is far longer than others have received for similar conduct.

James M. Cameron, a former assistant attorney general who was out on bail and living in Rome when he cut off a monitoring bracelet and drove to New Mexico before being stopped, appealed that sentence Tuesday to the 1st Circuit Court of Appeals.

Now 53, Cameron is imprisoned at the Englewood Federal Correctional Institution in Littleton, Colorado, and has a release date of Sept. 2, 2025, according to a federal prison website.

He was not present at the oral argument proceeding.

On Tuesday morning, his attorney, Peter C. Horstmann asked a three-judge panel in Boston to vacate that sentence and order a new sentencing hearing for Cameron.

At the same hearing, the federal government, through Assistant U.S. Attorney Renee M. Bunker, asked the judges to affirm the sentence. In documents filed with the court, Bunker said Cameron’s sentence was sound and reasonable and 127 months below the guideline range. She noted Cameron used various internet-based file sharing and chat programs to trade images of child pornography in 2006 and 2007. At the time, Cameron was living in Hallowell.

Horstmann said Tuesday that Cameron’s sentence was “twice as long” as those other defendants received for the same offenses.

In response to the government’s brief, Horstmann wrote, “Cameron contends that certain legally impermissible facts were erroneously considered as aggravating factors and that the (U.S. District Court in Maine) failed to adjust the sentence for certain aggravating factors that were found to no longer exist.”

Horstmann also said Cameron was not appealing the 24-month consecutive sentence for contempt of court that was a result of his jumping bail.

Cameron’s previous appeal to that appeals court resulted in a partial victory. In a decision issued Nov. 14, 2012, that court overturned convictions on six charges on the basis that they violated Cameron’s constitutional rights under the Sixth Amendment, which requires that those accused of a crime have a right to cross-examine witnesses. That court affirmed convictions on seven counts, sending the case back to the judge in Maine for re-sentencing or a new trial if the government chose to do that.

The prosecution declined, so Cameron was re-sentenced in December 2014. At that time, he apologized to the victims of child pornography and told U.S. District Court Judge John A. Woodcock Jr., “I freely admit that late in 2006 and throughout 2007, at a difficult time in my life, I became addicted to child pornography,” adding, “I did it, and I’m guilty because I did it.”

Cameron had been sentenced to 16 years in prison on the original 13 crimes involving child pornography. At the second sentencing, the total was 189 months — 15 years and 9 months, including the 24 months for contempt.

Woodcock issued a written order explaining how he calculated the 292-to-365-month guideline sentence in the case, noting that the guideline was enhanced, among other things, because 150 to 300 images of child pornography were involved, and some of them showed sadistic and masochistic conduct and that images showed adult males having sexual relations with very young children.

Cameron previously was the chief drug crimes prosecutor in the Office of the Maine Attorney General, where he spent 18 years as an assistant attorney general.

He became the target of an investigation after the National Center for Missing and Exploited Children reported Yahoo had found multiple images of child pornography in a Yahoo account belonging to Cameron’s wife.

Cameron was fired from the attorney general’s office in April 2008 and indicted on the child pornography charges Feb. 11, 2009.

He was suspended from law practice as a result of his convictions and later resigned from the Maine Bar and was disbarred in other states.

The appeals court panel issues decisions in writing and that can occur months after oral arguments are heard.

Gardiner man imprisoned 5 years for 2 Rite Aid robberies

BANGOR — A Gardiner man who robbed Rite Aids in Augusta and Gardiner will spend five years behind bars for those offenses.

Last August, Rudger S. Ellis, pleaded guilty to interference with commerce by robbery and pharmacy robbery for the Feb. 7, 2015, pharmacy robbery on North Belfast Avenue in Augusta and a Feb. 18, 2015, pharmacy robbery on Spring Street in Gardiner.

Ellis, now 23, was sentenced Wednesday by U.S. District Court Judge John A. Woodcock Jr.

Five of his family members and friends attended the hearing, watching the proceedings while seated behind Ellis in the courtroom.

He greeted them with a look and raised eyebrows, but all had been warned not to speak to him in court.

At the close of the hearing, Woodcock told them, “I can’t tell you the number of people I sentence who have no family behind them.”

He urged the family, “Continue to support him both while he is in prison and when he gets out.”

During the Augusta robbery, Ellis demanded oxycodone and oxycontin, both opiates, and Ritalin, a central nervous system stimulant, and ordered the pharmacy technician to hurry and threatened to use a gun. He wore a plaid cloth as a mask over his face.

During the Gardiner robbery, Ellis, again masked, demanded the pharmacist give him all the oxycodone 30 mg pills and again told the pharmacist to hurry.

The suspect discarded the blue plaid bandanna outside the Gardiner pharmacy, and it was retrieved by investigators. Later, tests showed DNA on the fabric was a match to that of Ellis.

Donald F. Brown, the attorney representing Ellis, said Ellis was worth saving and wanted to become a personal trainer.

The prosecutor, Assistant U.S. Attorney F. Todd Lowell, said Ellis had been in trouble since age 14, began injecting cocaine and heroin at 18, and was convicted of various crimes, receiving relatively short sentences.

“He needs to be deterred and others building a resume like his need to be deterred as well,” Lowell told the judge, urging a sentence at the top of the guideline range.

Ellis answered an initial series of questions from the judge, and later he apologized to employees and customers of Rite Aid

“I know this will never be enough and wish there was more that I could do,” he said. “I’m sorry.”

Ellis also apologized to his family, particularly his mother.

“I got so caught up in my addiction and became someone I’m ashamed of,” he said.

The prosecutor said Ellis at one point chased his mother around their home with a .45-caliber pistol, threatening to shoot her.

“Rite Aid on North Belfast Avenue seems to be a favorite target” of people in Augusta, Waterville and Gardiner, Woodcock said. “So we have not only a repeat offender but a repeat victim.”

Woodcock said the guideline sentence for Ellis ranged from 51 to 63 months. Woodcock ordered him to serve 60 months and to pay restitution of $726, to which a codefendant would be required to contribute.

“Mr. Ellis, it’s very clear to me that you need to grow up,” Woodcock said. “It seems to me you’ve been acting like a boy in a man’s body, thinking only of yourself and not thinking of the consequences to others.”

Woodcock imposed a $1,000 fine, saying it would force Ellis to get a job. He also imposed three years of supervised release to follow the prison term.

A Pontiac Sunfire was used as the getaway vehicle in both instances, and the wheelman, Steven C. Chaput, 39, of Chelsea, also pleaded guilty to the two robberies. The U.S. Attorney’s Office said in a news release that the two men planned the robberies together.

Chaput’s sentencing hearing is set for 10 a.m. April 19 in the same court.

During Ellis’ hearing, Woodcock said Chaput had a more serious criminal history and faces a sentencing guideline range of 70 to 87 months.

Last May, the same judge sentenced an Augusta man, Dominic J. Pomerleau, then 22, to seven years in prison for a robbery and an attempted robbery at two pharmacies in the city within 20 minutes of one another.
