Kennebec grand jury indicts 2 on assault, theft charges

AUGUSTA — A Skowhegan man and an Augusta woman were indicted Friday on charges in connection with an assault and robbery of an 82-year-old woman outside an Augusta grocery store in April.

The indictments against Tylor Anthony Reece, 21, and Star Marie Black, 24, were handed up by a grand jury in Kennebec County. An indictment is not a determination of guilt, but it indicates that there is enough evidence to proceed with formal charges and a trial.

Police at the time said the woman was hurt when Reece allegedly stole her purse April 18, 2016, at the Cony Street Hannaford. The victim was hospitalized with serious injuries.

Reece was indicted on two counts of robbery — one alleging use of physical force and the other alleging intent or intent to inflict bodily injury — and one count each of aggravated assault and theft by unauthorized taking, all related to the same incident.

On Friday, he remained at Kennebec County jail in lieu of $50,000 cash bail in connection with these charges.

Black was indicted on charges of hindering apprehension or prosecution of Reece, and theft by unauthorized taking in connection with the alleged assault and purse theft as well as one count of theft by deception at the Big Apple April 18, 2016, all in Augusta. She remains in the same jail in lieu of $25,000 bail in connection with these charges.

• Richard Paul Bryant Jr., 26, of Randolph, possession of sexually explicit materials of children under age 12 July 18-Sept. 20, 2012, in Randolph.

• Leland Carl Connor, 58, of Farmingdale, theft by unauthorized taking and misuse of identification April 25-May 14, 2015, in Gardiner.

• Gregorio Dario Diaz, 36, of Hartford, Connecticut, unlawful furnishing of scheduled drugs and unlawful possession of scheduled drugs April 19, 2016, in Waterville.

• Nicole M. Dyment, 19, of Auburn, escape and refusing to submit to arrest April 17, 2016, in Augusta.

• Jake L. Foster, 21, of Augusta, three counts of theft by unauthorized taking, all Jan. 25, 2016, in West Gardiner.

•Michael E. Freeman Jr., of Chelsea, burglary and theft by unauthorized taking March 14, 2015, in Chelsea, and burglary and theft by unauthorized taking March 1-31, 2016, in Farmingdale.

• Michael A. Gerrish, 33, of Readfield, criminal operating under the influence and aggravated operating after habitual offender revocation Sept. 30, 2015, in Readfield.

• Bryan L. Gervais, 39, of Ripley, domestic violence assault April 9, 2016, in Readfield.

Augusta crash injures 2, destroys truck

AUGUSTA — Two people were injured and a truck was destroyed early Saturday when the westbound truck went off South Belfast Avenue, hit a tree and burned up, according to Augusta police.

The passenger in the truck, Nicole Freese, 18, of Manchester, suffered substantial injuries that were not considered life-threatening, Augusta police Sgt. Eric Lloyd said. The driver, Cade Ayotte, 21, of South China, was less injured but was charged with operating under the influence, he said.

Ayotte said he fell asleep at the wheel before the truck, a 1998 Chevrolet S-10 pickup, hit the tree, according to Lloyd.

Both occupants were treated at MaineGeneral Medical Center in Augusta.

The accident occurred near the city’s Hatch Hill landfill. Police had to block South Belfast Avenue between Church Hill Road and Bolton Hill Road to enable Central Maine Power workers to remove the tree, which was endangering nearby power lines, Lloyd said.

4:26 p.m., Michael James Landrouche, 48, of Skowhegan, was arrested on a charge of drinking in public.

7:58 p.m., Melissa Anne Campbell, 38, of Madison, was arrested on a warrant for unpaid fine.

Police suspect teens in thefts of letters and numbers from business signs

The Somerset County Sheriff’s Department is investigating the theft of letters and numbers over the weekend from four business signs on Mercer Road, U.S. Route 2, in Norridgewock.

Chief Deputy James Ross said the thefts happened sometime late Friday night or early Saturday morning. Witnesses reported seeing three young men, possibly teenagers, running away from one of the businesses. Ross said police also are waiting for the businesses to open Monday morning to see whether video surveillance cameras are at any of the locations and might have captured the action.

“There were four entities over in Norridgewock that had numbers and letters stolen from their outside advertising signs,” Ross said by phone Sunday afternoon. “An employee of one of the businesses happened to be driving by around that time and saw the three young men who ran when they were seen, so that’s why they suspect it was them.”

Businesses that were targeted were Hardy’s Motorsports, Oosoola Country Store, Frederick’s Dar-I-Whip and Mill Stream Elementary School, Ross said.

Ross said the thefts are misdemeanor crimes.

Four arrested after gunfire at Augusta Wal-Mart

AUGUSTA — Four people were arrested Sunday after an incident in which two of them fired guns during a dispute outside Wal-Mart, and police armed with rifles surrounded the woods south of the University of Maine at Augusta in search of a possible fifth suspect.

In a media briefing Sunday evening, Augusta police Sgt. Christian Behr said shooting broke out between people in two vehicles at the Wal-Mart parking lot. After the shooting, one suspect emerged from one car and confronted people in the other car. The altercation was interrupted by two armed civilians.

The incident is still under investigation, and criminal charges will be forthcoming.

Behr said apparently the people in the vehicles knew each other.

The department confirmed via Twitter at 8:15 p.m. a shooting incident had taken place. Shortly afterward, Augusta police posted a description of the incident on the department’s Facebook page:

“At approximately 5:30 p.m., there was an altercation outside of Wal-Mart between several individuals. The altercation developed into two of the people involved firing guns. NO ONE was injured during the altercation or exchange of gun fire. At this time four people are in custody to include the two who were firing the guns. Information obtained at this time is that there is one female who was involved that fled the area. (Dog units) are being used to try and locate her. All of those involved in the incident were acquainted with each other in some way.”

The mention of no injuries notwithstanding, officers at the shooting scene pointed to a blood trail on the ground and to what they said were shell casings. Crime scene tape blocked off an area around a silver Volkswagen Passat with its doors open.

Officers from the Augusta Police Department, the Maine State Police and the Kennebec County Sheriff’s Office participated in the search for the missing woman Sunday along Civic Center Drive and into the woods east of there.

In addition to the state police and Kennoebec County Sheriff’s Office, the Hallowell, Winthrop, and Capitol police departments also assisted.

Oakland shooting victims among those added to Maine Murder Victims’ Memorial

The three Oakland residents who were killed in a shooting in November have been memorialized along with 10 other homicide victims on the Maine Murder Victims’ Memorial in Augusta.

Mike Muzerolle and sisters Amanda Bragg and Amy DeRosby were among those added to the monument this year and remembered in a ceremony at Holy Family Cemetery on Townsend Road in Augusta Sunday afternoon. The three were killed Nov. 4 by Herman DeRico, DeRosby’s partner, who then shot himself.

Also among those added to the black granite monument this year were Eric Williams, who was shot on Christmas morning in Manchester, and Stephanie Ginn Gebo, who was shot to death in Parkman June 5, 2015, allegedly by her former boyfriend, Robert Burton.

Another name goes back decades — Christopher Rines, who was 14 when he disappeared April 12, 1991, from his Pittsfield home. His body was later found in the Sebasticook River.

There were 83 names on the monument when it was first installed in late 2013 by the Maine chapter of Parents of Murdered Children. The monument was dedicated in June 2014. Last year, 11 names were added and 13 more were added this year.

Arthur Jette, who heads the Parents of Murdered Children chapter, said that the yearly event “gives people an outlet to be able to have an opportunity to share in safe company with those who’ve had similar circumstances and be able to share stories about their loved one.”

“We really, truly want people to be able to, when they’re speaking about their loved one, to be able to have a smile come to their lips before a tear reaches their eyes,” Jette told WCSH on Sunday.

Jackie Bragg, Bragg and DeRosby’s mother, told WCSH on Sunday that “it’s still too soon.”

“They say, ‘Think of the good times,’ but it’s hard to think of the good times. ‘Think of something fun that they did,’ and you know, my mind goes blank. I just, I can’t think of it,” she said.

She attended the ceremony Sunday because her children would want her to be strong, she said.

“They were great people. They didn’t deserve this. They hadn’t even been able to live their life yet. It’s not fair,” said Bragg.

A motive was never determined in the Oakland shooting case, which was closed in January. DeRico, 42, shot to death his girlfriend DeRosby, 28; her sister, Bragg, 30; and Muzerolle, 29, in Muzerolle and Bragg’s downstairs apartment at 41 Belgrade Road. He then shot himself in the driveway of the residence, where he and DeRosby lived upstairs. Bragg and Muzerolle’s 3-year-old daughter, Arianna, was the only survivor of the shooting.

Department of Public Safety spokesman Steve McCausland said in January that toxicology tests showed DeRico had amphetamines, methamphetamine, marijuana and alcohol in his system, and there was evidence of recent cocaine use. But he also said that investigators will never know a specific motive.

The families of Bragg, DeRosby and Muzerolle are also working with the town of Oakland to install a memorial bench at the town beach.

Burton, charged with killing Ginn Gebo, 37, pleaded not guilty in December. He turned himself in in August after a nine-week manhunt. Ginn Gebo was described by friends after her death as a caring person and “wonderful mother” to her two children.

Williams, 35, and Bonnie Royer, 26, were shot Dec. 25 at 3:30 a.m. on Sanford Road in Manchester. David Marble Jr. of Rochester, New York, has pleaded not guilty to the several charges related to their deaths. Williams at a memorial on Jan. 1 was described as a “big-hearted guy” who would drop everything to help a friend.

Rines’ homicide was never solved.

Court document: Money dispute at heart of shooting at Wal-Mart parking lot

AUGUSTA — A dispute over money was at the heart of a shooting Sunday evening in the parking lot in front of Wal-Mart, according to a police affidavit filed in court.

That detail arose as police on Monday continued to piece together what led up to the shooting, while also looking for a person they say is a witness.

Meanwhile, three of the four people arrested Sunday in connection with the shooting, which was apparently drug-related, made initial appearances in court Monday.

During the hearing for one of the suspects, Justice Robert Mullen said that the scene seemed “like an old Western shoot-out out in the Wal-Mart parking lot.” The confrontation ended when two armed bystanders intervened, police said.

Here are those charged:

• Kweasia “Reggie” McBride, 45, of Harlem, New York, charged with reckless conduct with a firearm, Class C, and aggravated trafficking in drugs (heroin), Class B. His bail was set at $50,000.

• Frankie Dejesus, 27, of Rochester, New York, charged with reckless conduct with a firearm, Class C, and aggravated assault, Class B. His bail was set at $25,000.

• Diana Davis, 28, of Rochester, New York, charged with aggravated assault, Class B. Her bail was set at $5,000.

• Samantha Tupper, 24, of Augusta, charged with probation violation and furnishing drugs (heroin), Class B. She is being held without bail.

The hearings for McBride, Dejesus and Davis at the Capital Judicial Center Monday were via video link from the Kennebec County jail in Augusta.

An affidavit by Augusta Police Detective Brian Wastella filed with the court outlines the investigation so far and indicates that those involved said “money being owed between parties” was at the heart of the dispute.

It says Tupper had been driving in a Ford Taurus to Wal-Mart when she picked up McBride on Mount Vernon Avenue, and that a silver Volkswagen with Dejesus driving and three women passengers approached them there. Two of the women got out and got into Tupper’s vehicle, and both vehicles went to Wal-Mart, parking side by side, and all the people got out.

Wastella said McBride, Tupper, Dejesus and Davis argued, and that some were telling Davis to stop.

McBride said Tupper and he got back into the Taurus when “he observed Dejesus point a handgun out the driver’s side of his vehicle at him. McBride stated in fear of being shot, McBride drew his handgun and began firing at Dejesus,” Wastella wrote. Dejesus told police McBride pulled the gun first and began shooting, so Dejesus began firing back.

Wastella said McBride got out of the car once the shooting stopped and began fighting with Dejesus and Davis, with the two beating on McBride. Tupper told police Dejesus hit McBride with the butt of a gun while Davis held him.

Dejesus told police he and Davis fought with McBride in self-defense, Wastella wrote.

Tupper and McBride then drove away, and police later found them at Tupper’s residence on Mayflower Road.

Wastella also says McBride was bleeding from lacerations on his head and that police found 42 grams of heroin on him.

Davis and Dejesus were found in the Wal-Mart parking lot in a silver Volkswagen, which had a bullet hole near the driver’s side door.

Police found a firearm in the Volkswagen and another on the ground in the Wal-Mart parking lot as well as bullet casings. There was no mention in the affidavit of any other firearms being located.

COURT HEARING

At Monday’s hearing, Mullen, the judge, told Davis that the charge of aggravated assault carries a maximum penalty of 10 years in prison.

Mullen agreed to Deputy District Attorney Paul Cavanaugh’s request to keep the $5,000 bail amount that was set by the bail commissioner with conditions that Davis have no contact with McBride, named as the victim of the assault, with Dejesus and with Tupper. Conditions also prohibit Davis from having firearms and dangerous weapons.

Jeffrey Towne, attorney of the day, said Davis indicated she can only raise $1,000 at the most.

“There’s no evidence she actually … handled a handgun or fired a shot in this incident,” he said.

Towne also said that the probable cause affidavit showed Davis was present at the scene “and a victim of other parties.”

When the judge asked about Davis’ ties to Maine, she said she has been living in Maine for the past month and a half and is a subcontractor doing demolition, landscaping and residential moving and that her brother moved up to Maine after she did.

Cavanaugh said he was not yet able to learn the disposition of a marijuana possession charge that was brought against Davis in Rochester, New York, in 2013.

“Can you ask them to release my phone to me so I can make the proper calls?” she asked the judge. ” I haven’t had my free call.”

She said she did not believe her phone was evidence.

“That’s the only way I can contact any of my family members,” Davis said. “I don’t have a number to call unless I get my phone.”

Mullen said once an attorney is appointed to represent her, something could be worked out.

Bail for McBride was continued at $50,000 with conditions that prohibit him from possessing weapons and illegal drugs and from contact with co-defendants.

He told the judge he intended to hire an attorney to represent him, but that he had yet to talk to anyone about it since he had just arrived at the jail. McBride did not have a head wound visible on the video monitor in the courtroom.

Towne, also representing McBride, said McBride requested bail be set at $5,000 cash.

Cavanaugh argued against lowering it, saying authorities have been unable to confirm McBride’s identity, coming up blank when running the address, Social Security number and date of birth that McBride provided.

“As I stand here today, I don’t know that this person is who he says he is,” Cavanaugh said, adding that results from fingerprints taken at the jail have yet to be returned.

Later, Cavanaugh described the heroin police found on McBride as “a block of heroin, not powder.”

Cavanaugh raised similar identity concerns about Dejesus as well in successfully arguing for Mullen to keep bail for Dejesus at $25,000.

Dejesus was represented by Stephen Bourget, also acting as lawyer of the day for those held in custody.

Bourget asked that bail be set at $5,000 cash or $1,000 with a Maine Pretrial Services supervision contract.

Bourget said Dejesus has been living in Augusta for the past four months, is a certified nursing aide in Massachusetts who also does warehouse work and has no criminal history. Dejesus also has a driver’s license from New York, Bourget said.

“It appears he was trying to break up a fight, got shot at and was trying to defend himself,” Bourget said.

The judge said part of the problem is that the events are so recent. However, he did not reduce bail, saying it could be reviewed later.

“This sounds like an old Western shoot-out out in the Wal-Mart parking lot and obviously can’t be countenanced,” Mullen said.

All three defendants are scheduled for hearings in October.

Tupper is charged with violating probation and will be seen in court later this week for that and charges stemming from the Wal-Mart incident, Cavanaugh said.

POLICE WORK THE CASE

Augusta Police Lt. Chris Massey said Monday that what sparked the shooting is being investigated.

Police know that shooting broke out between people in cars that were parked next to each other shortly before 5:30 p.m. Sunday.

When the shooting stopped, Massey said, two men and a woman emerged from the vehicles and fought. McBride, who had cuts and bumps on his head, was apparently injured in that fight, but he initially declined medical attention. Massey said he was later treated at a local hospital and that blood found at the scene is believed to have come from McBride.

At that point, he said, two bystanders, both armed with guns, broke up the confrontation.

“They had taken out their guns and told them to stop,” Massey said.

One of the vehicles stayed in the parking lot and the other fled. That car was stopped by Hallowell police as it pulled into a residence on Mayflower Road just off Eastern Avenue.

“We were looking for the car. We knew who it was registered to, and we had a good idea where it was headed,” Massey said.

At the same time, police had a report of a person who had fled on foot. That prompted police agencies to set up a perimeter around a wooded area bounded by Civic Center Drive, Bond Brook Road and the entrance to the University of Maine at Augusta.

That person, Massey said, is believed to be a witness to the shooting.

“We believe it’s a woman,” he said. “We’ve identified her, but we have not been able to speak with her. She’s not from Augusta, and she’s not considered dangerous.”

Police are still tracing the ownership of the silver Volkswagen Passat that remained in the parking lot until it was towed, and they are piecing together what the relationship among the suspects is.

Last month at a hearing at Capital Judicial Center, Tupper pleaded guilty to unlawful trafficking in cocaine base and was sentenced to an initial 45 days in jail, which she already had served, and the remainder of the four-year sentence was suspended. She was placed on probation for two years for that offense, which occurred July 28, 2015, in Randolph.

In exchange for her guilty plea to the unlawful trafficking charge, two other charges of aggravated trafficking in cocaine base from July and August 2015 in Augusta were dismissed.

Officers from the Augusta Police Department, the Maine State Police and the Kennebec County Sheriff’s Office participated in the search for a possible fifth person Sunday along Civic Center Drive and into the woods east of there. As of Tuesday evening, information was not available on whether police had found the witness.

‘It was instinct’ for armed bystander to break up shooting in Augusta store lot

AUGUSTA — Daniel Chavanne was walking out of Wal-Mart Sunday evening with his wife, daughter, son and mother when he heard the argument across the parking lot. They got inside their vehicle and started to back up when they heard the noise.

Four shots — “pop, pop, pop, pop!”

Carrie Chavanne said her husband, with a gun in his belt, stopped the car and got out.

“It didn’t take him long to think. It was instinct for him to get out and do what he did,” she said in an interview Monday with the Kennebec Journal.

Daniel Chavanne walked over to the nearby scene of the shooting and dispute, showed his Glock 42 pistol, announced he was armed and told those fighting to get down on the ground.

He kicked one of the guns away from a man on the ground and held it down with his foot.

“That was the moment, that was the situation that was there and I reacted. All life is valuable. All lives matter,” Daniel Chavanne said in an interview with television station WCSH. “If a situation is there, you have not just a personal responsibility but a civil responsibility to uphold the sanctity of the community.”

Less than a day after Chavanne helped break up a shooting and a fight in the Wal-Mart parking lot, Carrie Chavanne said it boiled down to this: “Seven minutes with guns are seven really bad minutes.”

Daniel Chavanne, 39, and another armed passerby were legally carrying guns and are credited by police with halting the violent altercation among four people who are now under arrest on a variety of charges. But even though “it turned out OK and it didn’t escalate into more shooting,” Augusta Police Lt. Christopher Massey said Monday that “going forward, we would not encourage anyone to intervene.” Police said no one was injured by gunfire during the incident.

“From our standpoint,” Massey said, “everybody has a constitutional right under the Second Amendment to have a gun. In an incident like this, we certainly would tell people that they should get themselves and their families to safety and be a good witness.”

The tense situation and the involvement of armed bystanders in the Augusta incident comes in the wake of the deadliest mass shooting in U.S. history at an Orlando nightclub and ensuing political debate about gun control and armed citizens.

Gov. Paul LePage, in a town hall meeting in Richmond last week, said he was not in favor of everyone running around with a gun, but he would protect his family with a gun if he had to. Presumptive Republican presidential nominee Donald Trump has said armed people could have stopped the Orlando nightclub gunman.

Those questions played out online and in social media Monday as commenters debated whether armed civilians should intervene to stop shootings.

“The big thing for civilians to understand is that it’s a dangerous situation,” Pete Blair, executive director of Advanced Law Enforcement Rapid Response Training at Texas State University, said in an interview Monday. ALERRT was formed in 2002 to address the need for active shooter response training for first responders. In addition to training, the center has established a criminal justice research department.

“We’re not big advocates for civilians to find the bad guy and stop him,” he said, adding that dangerous situations can be complicated by the fact that more than one armed civilian could react to a shooting and it’s hard to identify all involved. “There are a lot of things to be aware of.”

But Todd Tolhurst, president of Gun Owners of Maine, said civilians usually know who the bad guy is: “It’s the one that just attacked them.”

Tolhurst said innocent bystanders could easily have been injured in Sunday’s Augusta shooting if Chavanne and the other bystander had not stepped up and stopped the altercation as soon as they did.

“Responsible gun owners do have training on what you have to do in the wake of a lawful defense,” he said, noting that both Daniel and Carrie Chavanne are members of Gun Owners of Maine. “If you look at the statistics regarding shootings of bystanders, it happens more often in police shootings than those with civilians. It happens, and I am not denigrating the police here.”

Carrie Chavanne said she and her family planned to pick up some groceries and have dinner at the home of Daniel’s mother, who was with them. While Carrie Chavanne is a gun owner, she didn’t have hers with her.

“We got there about 5,” Carrie Chavanne said Monday from the family’s home in Washington. “We were just coming out when we heard the argument going on. You hear arguing all the time, and you don’t want to pay attention.”

When Daniel Chavanne heard the shots and confronted the suspects, a second man who police have declined to identify, also walked up to what was by then a fistfight between two men — now identified by police as Kweasia “Reggie” McBride and Frankie Dejesus, on the ground. Chavanne said one of the women involved appeared to be breaking up the fight, but it also looked like she was joining in.

In the car, Carrie Chavanne said, her mother-in-law was calling 911. She tried twice and couldn’t get through, but eventually did.

McBride had backed off from the fight, but in doing so was getting close to the Chavannes’ vehicle. Chavanne said she stepped out of the vehicle and yelled at him. He appeared to be reaching for something while staring at Daniel Chavanne.

“I said my kids were in the vehicle. Don’t put my kids in danger,” she said, characterizing herself as a “shrieking banshee” woman. “My mother bear came right out. It wasn’t a nice yell. I didn’t let him close to the vehicle because if someone is carrying a gun, you don’t know if they are carrying more than one.”

She said he looked dumbfounded for an instant before he started chasing after the white Taurus that was leaving the scene.

When police arrived soon thereafter, both her husband and the other armed civilian were identified as not being part of the altercation.

The Chavannes remained in the parking lot for about two hours. After a brief stop at Barnes and Noble, they stopped at Denny’s restaurant for dinner.

Chavanne said both her children witnessed the events. Her daughter, 17, is fine. Her 7-year-old son, who is on the autism spectrum, is having a harder time.

Thinking about it now, she said, she realizes the people in the cars could have shot anywhere.

Even so, she said, they would intervene again.

“We value human life, and every life is worth saving,” she said. “It’s really easy to step in and help when someone needs groceries, but it takes someone special to step in and help in a situation like this. It wasn’t his job, but it was something he believed in. We’re very proud of him.”

Massey, the Augusta police lieutenant, said both Chavanne and the other man were legally “open carry,” he said, meaning carrying their weapons in plain view. Neither discharged their weapons.

“They were just people at Wal-Mart, shopping,” Massey said. “They did not approach when the shooting was going on.”

Under Maine law, state residents who are 20 and older are allowed to carry concealed weapons except where weapons are prohibited. For instance, they are banned in schools, federal buildings and private property when prohibited by the property owner.

Robert Schwartz, executive director for the Maine Chiefs of Police Association, said that such encounters as the Augusta incident could become more common as more people arm themselves. As a general rule, he said, “We like to have people stay out of (shooting situations) because it makes things more complicated.”

Even so, Schwartz said most gun owners are responsible, and if someone uses a gun in defense of his or her family, police will sort it out.

“This is the beginning of something that will be a concern for law enforcement,” he said. “There will be a discussion.”

Bingham man with sex offense history indicted by Somerset County grand jury

A repeat sex offender from Bingham whose release on bail last month alarmed the Somerset County sheriff has been indicted by a grand jury on felony sex charges that allegedly occurred in Smithfield in May and in Skowhegan in August.

Christopher Cates, 41, is charged by the Somerset County grand jury with intentionally subjecting a woman who had not expressed or implied her acquiesence to sexual contact, according to the indictment. The two charges of unlawful sexual contact are Class C felonies, each punishable by up to five years in prison and a $5,000 fine.

An indictment isn’t an indication of guilt, but a determination by the grand jury that there’s enough evidence to proceed with a trial.

Somerset County Sheriff Dale Lancaster said after Cates was arrested for a second time in two weeks earlier this month that he was concerned Cates was free on bail because of his history. Chief Deputy James Ross of the Somerset County Sheriff’s Department said Monday police have not had a problem with Cates since his release on bail several weeks ago.

Cates has a history of sex crime convictions going back two decades and is a registered sex offender.

The unlawful sexual contact charges were originally misdemeanors, but were elevated to felonies the week after Cates’ arrest. Somerset County District Attorney Maeghan Maloney said Cates’ criminal history of sexual contact charges warranted a more serious charge.

Cates also was indicted in June on misdemeanor charges of violating conditions of release on a previous charge and simple assault.

Cates was arrested May 25 after a Smithfield woman told police on May 9 that Cates assaulted her while visiting her property under the pretense of looking at a car she was trying to sell.

He allegedly told her she had a tick on her leg, she told police, and when she panicked and asked him to remove it, he allegedly touched her crotch, according to an affidavit filed in Skowhegan District Court by Somerset County Sheriff’s Detective Jeremy Leal.

Police said when they first went to Cates’ house to arrest him after that report, Cates’ father stalled a sheriff’s deputy at the front door of their house while his son escaped on foot. Cates was arrested May 25 when he appeared in court on a charge of operating after suspension. He was freed on bail May 25 on that charge.

A Norridgewock woman who saw Cates’ photo in the media after his May 25 arrest called police and said she recognized him as a man who had assaulted her in a similar way in August. He was arrested June 2 on charges of unlawful sexual contact and assault related to that case and was released on bail June 3.

According to the indictment, Cates was convicted of unlawful sexual contact on Dec. 31, 1996, in Augusta District Court. He also was convicted of the same crime May 31, 2000, in Waterville District Court. He again was convicted of unlawful sexual contact on Dec. 16, 2003, in the Augusta court, unlawful sexual touching Aug. 7, 2008, in Farmington Superior Court and on a charge of prohibited contact with a person under 14 years of age Sept. 17, 2014, in Somerset District Court.

Cates is out on $5,000 cash or $50,000 property bail.

Norridgewock man indicted on domestic violence, aggravated cruelty to animals

SKOWHEGAN — A Norridgewock man accused of domestic violence assault and with aggravated cruelty to animals for allegedly crushing the skulls of two kittens during a domestic dispute May 29 is among 15 people indicted last week by a Somerset County grand jury.

Vance A. Cayford Jr., 45, faces five criminal charges, three of them felony charges.

In a court affidavit, police said Cayford threatened a woman with a gun, refused to submit to arrest and killed the two kittens by smashing their heads on the corner of a refrigerator, all May 29.

Cayford, who was convicted in July 2014 of possession of a firearm by a felon in 2014 in Norridgewock and sentenced to three months in jail, now faces new criminal charges.

He is charged by the grand jury with domestic violence assault, domestic violence criminal threatening with a dangerous weapon, aggravated cruelty to animals, violation of a protective order and refusing to submit to arrest.

An indictment is not a finding of guilt, but an indication that enough evidence is present to proceed with a trial.

Also indicted by the grand jury were:
