A man who allegedly shot and killed three people in June in New York may be hiding out in Maine, according to New York police.

The New York Police Department received tips that Sam Cross may be in Maine, according to a report by News Center Maine (WCSH/WLBZ).

Cross is wanted in connection with the killings on June 21 in the Bronx.

Brewer Police released a description of Cross on Friday. He is described as African American, standing 5’9″ and weighting 200 lbs, with black hair and brown eyes.

A reward of up to $10,000 is being offered for information on his whereabouts and the three deaths.

The former treasurer of the Litchfield Fair has been charged with embezzling more than $10,000 from the Litchfield Farmers’ Club, which runs the fair.

Club officers say more than $80,000 disappeared from the various accounts over the past two years.

Ryan A. Beaudette, 36, of Litchfield was charged Thursday afternoon by Kennebec County Sheriff’s Office Detective John Bourque.

The charge, a Class B felony, indicates more than $10,000 was stolen, and carries a maximum 10-year term of imprisonment.

Beaudette had been treasurer of the club for the past two years, and a press release from the sheriff’s office says Beaudette “confessed to stealing over $10,000.”

Bail has not been set, according to the release.

BOSTON – A South Portland man working as a Massachusetts fishing boat captain has pleaded guilty to interfering with a U.S. Coast Guard inspection.

Prosecutors say 57-year-old Thomas Simpson pleaded guilty in federal court Thursday to destruction or removal of property subject to inspection.

Prosecutors say Simpson, of South Portland, Maine, was the captain of a New Bedford commercial fishing boat in 2014 when he dumped a fishing net into the ocean in defiance of Coast Guard commands to haul it in.

A salvage company later retrieved the net and found it was in violation of commercial fishing regulations.

The vessel was one of several owned by Carlos Rafael, known as “the Codfather,” who was sentenced to nearly two years in prison for violating several fishing regulations.

Simpson faces up to five years in prison at sentencing.

ROCHESTER, N.H. – An autopsy shows that a man who died in a shootout with police in New Hampshire suffered multiple gunshot wounds.

Thirty-eight-year-old Douglas Heath was wanted on several outstanding warrants, including one for trafficking narcotics and another for fleeing from Maine troopers. Authorities say he led them on a chase before he crashed in Rochester on Monday.

They said that when Heath got out of his car, there was an exchange of gunfire and he died at the scene. A gun was found next to him. No one else was hurt.

The attorney general’s office said two Rochester officers and two state troopers were on the scene at the time of the shooting. All four are on administrative leave.

Two women are alleging that a city law firm schemed with a former Portland developer to defraud investors of nearly $50 million.

George Marcus

Their class-action lawsuit filed this week in federal court cites another ongoing lawsuit against businessman Michael Liberty. Rather than target Liberty himself, the women’s suit goes after Portland attorney George Marcus and his firm, Marcus Clegg.

The federal Securities and Exchange Commission charged Liberty and several other people in April, alleging they tricked people into putting money into a tech startup and instead used the funds for chartered flights, expensive homes and cars, production of a movie and even the purchase of a dairy farm in Maine.

Marcus, who represented Liberty, is among those facing charges in the SEC’s lawsuit. He is accused of providing legal advice on handling the investments and drafting documents that misrepresented or omitted facts about the investments. Both Marcus and Liberty have denied the agency’s allegations.

Now Tina Endicott of Massachusetts and Denise Medina of Florida have filed their lawsuit, which says they lost money investing in Liberty’s supposed startup. The complaint, filed Wednesday in U.S. District Court in Portland, calls Marcus a “co-conspirator” in the alleged plot. The complaint does not state how much money they invested or lost, and they seek unspecified damages for a class of investors.

Lee Bals, a partner at Marcus Clegg, said Friday that neither woman has ever been a client of the firm. He said he was still reviewing the civil complaint, but the firm’s first step would be filing a motion to dismiss.

“This firm did not represent these individuals,” Bals said. “This firm does not know these individuals. Mr. Marcus does not know these individuals. The complaint itself is replete with inaccuracies and misrepresentations.”

Michael Liberty

The plaintiffs are represented by three law firms in Maine, Pennsylvania and Iowa. The local attorney directed questions to the other two involved in the cases, and messages at those firms left Friday were not returned.

“I think we have an excellent reputation, and I think it is wildly inappropriate for some out-of-state lawyers to come in and make allegations that have no basis in fact,” Bals said.

Liberty was a top Portland developer in the late 1980s. Before he moved out of Maine, he helped build the 100 Middle St. office complex and the Chandler’s Wharf waterfront condominium complex.

The current legal battle revolves around Mozido, a Texas-based company that Liberty founded. It was supposed to develop cellphone applications for mobile banking and other financial services.

According to the SEC’s lawsuit, Liberty sold investors shares in shell companies that supposedly could be converted into stock in Mozido. But, according to the SEC, the shell companies either didn’t have convertible shares or were barred from transferring the investments.

Liberty and the others, the lawsuit charges, lied to the investors about Mozido’s valuation, finances, Liberty’s investments and how their funds were to be used.

The class-action lawsuit filed Wednesday echoes those allegations, focusing on Marcus’ role in the alleged plot. It states misconduct by the law firm that includes “their drafting of faulty and misleading legal documents and their negligent and improper handling of investor funds.”

For example, the complaint says that when the head of Mozido’s board raised red flags about Liberty in 2013, the lawyer misled him.

“Remarkably, Marcus defended his partner and co-conspirator, Liberty,” the complaint reads. “He wrote the Executive Director and said, untruthfully, that Liberty had only raised funds from investors in his circle of friends, and that all of the investors were accredited investors.”

Bals said Friday that Marcus had never talked to investors and had only limited interactions with lawyers for investors.

“There were no misrepresentations made in any of those conversations,” Bals said.

Marcus is a senior member of his firm. He does not have a discipline record with the Maine Board of Overseers of the Bar.

This is not the first time Liberty has been in legal trouble.

Last year, Liberty pleaded guilty in federal court in Portland to violating campaign finance laws.

He served four months in federal prison and paid a $100,000 fine.

Liberty is also in the SEC’s cross hairs in Pennsylvania, where he paid a $600,000 fine years ago for allegedly defrauding investors there. Now, the agency’s lawyers are saying he lied about his finances to reduce the amount of the penalty and they are asking a federal judge to reinstate the fine to the original amount, $6 million.

A Philadelphia law firm – the same one listed on the class-action complaint filed this week – had said it was recruiting investors who lost money to join together to recover their investments.

AUGUSTA — A city man has been arrested on two charges of unlawful sexual contact with a girl under age 12.

Robert Matteson, 43, was arrested Thursday and taken to the Kennebec County jail.

He made an initial court appearance on the two charges — which each carry maximum penalties of 10 years in prison — on Friday at the Capital Judicial Center via video from the jail. A judge set his bail at $2,500 cash with a Maine Pretrial Services contract.

According to an affidavit by Augusta police Officer Benjamin Murtiff, the investigation began after a referral from the Department of Health and Human Services. The complaint says the incidents occurred between Feb. 2 and May 4 in Augusta.

Murtiff says the girl was 10 at the time and reported that the contact occurred at Matteson’s home.

York police are asking the public’s help to find whoever is responsible for calling in a fake bomb threat Friday afternoon.

Police said dispatchers received a call at around 3:40 p.m. reporting a bomb threat at a home off Shelton Avenue. The call came from a woman who had said she had received the threat on her cellphone while she was out of the house.

Police, fire and ambulance crews responded and evacuated the residence and area houses. Nothing suspicious was found at the residence, police said.

“A thorough investigation of the incident and information obtained showed that the bomb threat was a hoax,” Sgt. John Lizanecz said in a statement.

Police are investigating the theft of a sign at the newly renovated Waterhouse Field in Biddeford.

Thieves made off with orange letters spelling out “Tiger Pride,” but Superintendent Jeremy Ray says that pride remains as strong as ever.

“This will be something that will just make us stronger,” Ray said Friday night. “It will bring us together even more and our volunteers are even more determined to make sure we move forward.”

Ray said the theft occurred Thursday night. Volunteers had been at the field until 9:30 p.m. after putting some finishing touches on an 18-month renovation of the athletic facility.

The project included a new turf field, bleachers, a press box, lights and groundwork. Much of the project was done with funding, supplies and labor donated by the community.

The theft was discovered around 11 a.m. Friday, Ray said, valuing the loss at over $1,000.

“There is a lot of sweat equity in this field, for sure,” he said. “That’s what’s disappointing.”

Ray said the first field hockey game is scheduled to be held next Friday at the field, before the grand opening on Sept. 7. He said new lettering will be ordered and installed as soon as possible.

Biddeford Superintendent Jeremy Ray said said the theft of the “Tiger Pride” sign at Waterhouse Field “will be something that will just make us stronger.

New security cameras are scheduled to be installed Monday, he said.

Bil Moriarty , a former school board member whose daughter recently graduated from Biddeford High School, said he and other community members are upset by the theft, especially because the project was nearly finished.

“It’s frustrating. After months and months and months of watching these volunteers go in on the weekends and afternoons, on rainy days and 100-degree days – that’s insane,” Moriarty said. “That’s horrible for someone to go in and desecrate this beautiful stadium. But it’s not going to get us down. We’re going to keep going.”

Moriarty echoed Ray’s words about Tiger Pride. “Even if the words aren’t there, we all feel it and we all know it,” he said.

Biddeford police did not have any information to release Friday night, but Ray said they were “working diligently” to find the culprit or culprits.

“It’s disappointing that someone would do that, but with our group of volunteers we have here working on this field, they won’t be deterred by this,” Ray said. “It’s a sign that says ‘Tiger Pride.’ And Tiger Pride is really what these volunteers have been all about.”

The owner of the Noyes Street duplex where six people died in a 2014 fire has reported to jail to serve his three-month sentence for a misdemeanor safety code violation that contributed to the deaths.

Gregory Nisbet is believed to be the first landlord sent to jail for a safety code violation.

Gregory J. Nisbet, 52, reported to the Cumberland County Jail on Wednesday and is now housed in a unit alongside other sentenced inmates, said Corrections Capt. Steve Butts. Nisbet’s jail term is believed to be the first meted out to a landlord for a safety code violation.

Like most inmates not on special restrictions, Nisbet will spend all but roughly 15 hours a day locked in a cell. As long as he follows the rules, he will be eligible to reduce his jail time by one week per month, and can earn even more credit if he gets a job in jail.

“As long as he’s behaving himself and following the rules, the (classification) committee will review him and could approve him for inmate work,” Butts said.

Nisbet’s latest possible release date is Nov. 20, according to jail records.

His stint behind bars ends a three-year legal saga that began in 2015 with a nine-count grand jury indictment, including for six counts of manslaughter.

Nisbet waived a jury trial. His case was heard in 2016 before a Cumberland County judge. He was found not guilty of the manslaughter charges, but was found guilty of a single misdemeanor safety code violation for failing to provide a secondary means of escape on the upper floor of the two-family home, among other factors.

At the crux of the case were the building’s third-floor windows, which were too small to serve as a secondary means of escape. A contractor notified Nisbet of the non-compliant windows, but Nisbet did not replace them. He argued at trial that he provided the third-floor tenants with a rope ladder to escape, satisfying his duty under the safety code.

After his 2016 conviction, Nisbet remained free while he appealed the case, arguing in part that the building safety codes were designed for modern structures, and that the state’s fire code is unconstitutionally vague and inconsistently enforced.

Maine’s highest court disagreed, however, and on Aug. 2 issued an opinion upholding his conviction and sentence.

Killed in the blaze were Nicole “Nikki” Finlay, 26; David Bragdon Jr., 27; Ashley Thomas, 29; Maelisha Jackson, 23, of Topsham; Steven Summers, 29, of Rockland; and Christopher Conlee, 25, of Portland. Bragdon, Finlay and Thomas were tenants. Jackson, Summers and Conlee were visiting the house for a Halloween party.

The duplex at 20 Noyes St. caught fire in the early hours of Nov. 1, 2014, when the young people inside were sleeping.

Investigators said the blaze started on the front porch in a plastic receptacle for cigarette butts and spread to a couch and chair nearby. It tore quickly through the building, which lacked functioning smoke detectors. Flames blocked a stairwell that might have allowed the people inside to escape.

The fire prompted an intense review of building inspection procedures in Portland, and led to the creation of a new city division, the Housing Safety Office, focused on building safety and inspections. To fund the office’s work the city imposed a fee on landlords of $35 per unit beginning on Jan. 1, 2016.

Nisbet’s sentencing sent shock waves through the landlord community. Some criticized the policy of prosecuting building owners for conditions inside apartment units, arguing that landlords do not have direct control over every aspect of a building’s condition at all times.

Tenants frequently remove or disable fire alarms, or block mandatory pathways of escape with furniture or other belongings, they said.

Carleton Winslow, the vice president of the Maine Apartment Owners and Managers Group, said he thought the manslaughter charges were a stretch.

“I think it was a minimal sentence, given the circumstances, but I think there were other things that (Nisbet) ignored, as reported,” said Winslow, who said he was speaking only for himself. “I do think the whole thing served as a wakeup call to a lot of people.”

Arrest

IN AUGUSTA, Sunday at 5:00 a.m., Jay Allen Buotte, 56, of Augusta was arrested on a charge of disorderly conduct (loud noise), on Chapel Street.

Summons

IN AUGUSTA, Sunday at 4:16 a.m., a 51-year-old Sidney man was summonsed on a charge of operating while license was suspended or revoked, after a traffic stop was done on Bonenfant Roundabout.

The state of New Hampshire’s most wanted fugitive was arrested last week during a traffic stop on Route 302 in Windham.

Michael Mendoza, who was a passenger in the car that was stopped, along with another passenger, Brian Higgins, were arrested by a state trooper and members of the U.S. Marshals Violent Fugitive Task Force, according to a post on the Maine State Police Facebook page.

Mendoza – for whom no address or age were given – was described as “New Hampshire’s most wanted fugitive of the week.” The arrests were made on Wednesday.

Mendoza was taken into custody without incident.

Officers found narcotics on the floor of the motor vehicle and on Higgins, state police said. Because there was a 2-year-old child in the car at the time, both men were charged with aggravated trafficking. Each man was held on $50,000 bail at the Cumberland County Jail.

Warrants on Mendoza included failure to appear, aggravated eluding an officer, leaving the scene of a motor vehicle accident, aggravated driving to endanger, and a probation revocation for unlawful trafficking in schedule W drugs.

Officers found numerous bags used to package narcotics, a scale, 20 grams of fentanyl, 6 grams of cocaine, suboxone and prescription pills in the vehicle, according to state police.

ALFRED — An Acton woman accused of stabbing her former husband to death in February 2017 after learning he had been awarded custody of their two children pleaded guilty to murder Monday.

Kandee Collind, 48, formerly known as Kandee Weyland, entered a guilty plea to a charge of intentional and knowing murder at a hearing in York County Superior Court. The plea avoids a trial, which had been set to begin on Sept 17.

She initially pleaded not guilty during a court appearance in May 2017.

Collind faces a minimum of 25 years in prison. After the hearing, her attorney, Clifford Strike, said a plea agreement caps the sentence at 32 years. Collind is scheduled for sentencing on Nov. 19.

“She wanted to spare her children the trauma of a trial, which I think is honorable and the correct decision,” Strike said. “She is at peace with her decision.”

Collind told police that both children were in the car with her when she pulled into the driveway, crashed into a parked pickup truck and got into a confrontation with her ex-husband, Scott Weyland, according to a court affidavit filed by Maine State Police Detective Corey Pike. The children allegedly witnessed the stabbing.

The affidavit noted that one of the couple’s two children called 911 at 12:55 p.m. on Feb. 22, 2017, and said Collind had stabbed Weyland in the chest.

Nine minutes later, York County Sheriff’s Deputy Tom Searway arrived at 1097 Milton Mills Road in Acton, where Weyland had been living with his mother.

Searway allegedly found Collind administering CPR to her former husband outside on the ground. She was crying hysterically, and told Searway that she had stabbed him in the chest, and that he had pulled out a knife as well.

An autopsy revealed Weyland died of a stab wound to the chest, with penetration of the heart.

In court Monday, Collind, showing no emotion, quietly responded “yes” when Superior Court Justice Wayne R. Douglas asked if it was her intent to plead guilty to the charge.

Strike acknowledged that had the case gone to trial, the state could have proved its case against Collind.

The confrontation was sparked by a letter Collind received a few days after the couple’s divorce was finalized on Feb. 17, 2017, which awarded primary physical custody of their two children to her ex-husband.

According to police, Collind was taken into custody on the day her husband died and was taken to a hospital for evaluation. She was treated at Southern Maine Health Care in Biddeford for minor lacerations and, according to the affidavit, was found to be concealing a small knife stuck in her abdomen.

A New York man was arrested on drug trafficking charges after Westbrook police say they found drugs and a stolen firearm in a Reed Street apartment on Saturday.

Westbrook police and the Maine Drug Enforcement Agency last week began investigating alleged drug trafficking at 27 Reed St. and obtained a search warrant for apartment 2, according to police.

During the search, Westbrook police found 89 grams of suspected cocaine, 36 grams of suspected crack cocaine, 26 grams of suspected Fentanyl, more than $9,000 in cash and a loaded 9 mm firearm that had been reported stolen in Virginia.

Police arrested 32-year-old Keon Grant of Brooklyn, New York, on a charge of aggravated trafficking in scheduled drugs, a Class A felony. He was taken to Cumberland County Jail.

Westbrook police say the investigation is ongoing and more charges are possible.

The Cumberland County Sheriff’s Department Emergency Services Unit helped serve the search warrant because of the possibility firearms were in the Reed Street apartment.

AUGUSTA — Neighbors who offered an Augusta man a plate of food after he’d told them he hadn’t eaten much recently didn’t get the response they might have expected Sunday night.

Police say the man allegedly rejected a meal from the two neighbors before threatening to shoot them with a loaded shotgun.

BRUCE ROY

Bruce M. Roy, 48, was arrested Sunday night at his Eastern Avenue apartment, police said, after they arrived about found him standing on the porch, still armed with the shotgun.

In an affidavit filed at the Capital Judicial Center, Augusta police Officer Kyle Sheridan said he ordered Roy to drop the gun, and Roy complied.

Sheridan said Roy said he “was standing inside his apartment and could hear the neighbors in the apartment above him making statements about wanting to hurt and kill someone,” and he believed the neighbors were talking about him.

The man who is listed as a victim of threatening told police that an hour earlier he and Roy had smoked marijuana together, and that he and a woman who lived in a neighboring apartment brought Roy a plate of food for dinner because Roy said he hadn’t eaten much recently.

Roy returned it, apparently uneaten, and said to quit doing it.

Then, when the two neighbors were outside smoking a cigarette, Roy allegedly pointed a shotgun at them and threatened them, Sheridan said.

Sheridan said the seized shotgun has a shell inside the chamber and two more inside the firearm.

Roy was unable to post the $2,000 bail set by a bail commissioner and was taken to the Kennebec County jail that night. He was scheduled to make an initial court appearance Monday afternoon via video from the jail.

At court, Justice Donald Marden told Roy he was being charged with criminal threatening with a dangerous weapon, which carries a penalty of up to five years in prison and $5,000.

The prosecutor, Assistant District Attorney Kristin Murray-James, asked for $5,000 cash bail, citing “the severity of the situation here. Mr. Roy was holding a shotgun at his neighbors.”

Attorney Stephen Bourget, representing Roy as lawyer of the day, asked for a low cash bail or one that was unsecured but accompanied by a Maine Pretrial Services contract.

Marden set Roy’s bail at $1,000 cash with a Maine Pretrial Services contract and included conditions prohibiting Roy from possession of firearms and from use or possession of marijuana.

A condition of bail prohibits Roy from being at the apartments of the two victims.

Marden, after learning that the neighbors must pass by Roy’s door to get to their apartments, told Roy, “You’re not to have any contact with those people.”

The judge also asked the district attorney’s office to contact the neighbors about the bail condition.

“Tell them they are not to put him in a situation where he cannot avoid contact,” Marden said.
