Sidney man to serve 30 months in prison following Augusta attack

AUGUSTA — A Sidney man pleaded guilty Monday to a charge of aggravated assault that helped land him in prison for 30 months to be followed by an eight-year suspended sentence and three years’ probation.

Marlon B. Cloutier, 25, was sentenced at the Capital Judicial Center.

In exchange for the plea, charges of assault and criminal use of disabling chemicals were dismissed by the prosecutor.

Cloutier was accused of using pepper spray last August on a 43-year-old man on Mount Vernon Avenue in Augusta and then hitting him with a billy club or baton in a dispute that started over what Augusta police were told was an apparent $30 debt. The incident occurred on Aug. 21, 2015.

Cloutier also pleaded guilty Monday to charges of burglary and theft that occurred Aug. 4, 2015, at Exit 21 Self Storage on Middle Road in Sidney. He and two others were accused of breaking into various storage units and stealing firearms, outdoor equipment, tools, hunting and fishing gear and a lawn mower. The Kennebec County Sheriff’s Office, which investigated that incident, indicated many of the items were recovered.

Cloutier was ordered to pay up to $2,188 in restitution.

Another charge of theft by unauthorized taking and a charge of possession of burglar’s tools from the same date were dismissed in exchange for that plea.

On the aggravated assault charge, Cloutier was given an eight-year, all-suspended sentence. That kicks in after he serves 30 months for the burglary and theft. The 30-month sentence runs at the same time as a 30-month probation revocation. Cloutier had been on probation after being convicted in 2010 of domestic violence assault and domestic violence terrorizing charges.
